Pro v\u011bt\u0161\u00ed p\u0159ehlednost jsme n\u00e1\u0161 souhrn rozd\u011blili na \u010d\u00e1st v\u011bnovanou pravideln\u00fdm zm\u011bn\u00e1m, kter\u00e9 p\u0159inesl nov\u00fd rok a v\u00a0druh\u00e9 \u010d\u00e1sti je p\u0159ehled d\u016fle\u017eit\u00fdch legislativn\u00edch zm\u011bn za posledn\u00ed obdob\u00ed,\u00a0 kter\u00e9 by v\u00e1m rozhodn\u011b nem\u011bly uniknout.<\/p>\n<h3><strong>Pravideln\u00e9 zm\u011bny<\/strong><\/h3>\n<h4>Zv\u00fd\u0161en\u00ed minim\u00e1ln\u00ed mzdy <a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/h4>\n<p>S \u00fa\u010dinnost\u00ed od 1. ledna 2023 byla minim\u00e1ln\u00ed mzda v \u010cesk\u00e9 republice zv\u00fd\u0161ena na 17 300 K\u010d m\u011bs\u00ed\u010dn\u011b nebo 103,80 K\u010d za hodinu. S ohledem na zv\u00fd\u0161en\u00ed minim\u00e1ln\u00ed mzdy byla zv\u00fd\u0161ena i minim\u00e1ln\u00ed zaru\u010den\u00e1 mzda.<\/p>\n<p>Zv\u00fd\u0161en\u00ed minim\u00e1ln\u00ed mzdy m\u00e1 tak\u00e9 n\u011bkolik souvisej\u00edc\u00edch dopad\u016f v oblasti dan\u011b z p\u0159\u00edjmu a n\u011bkolika d\u00e1vek soci\u00e1ln\u00edho zabezpe\u010den\u00ed.<\/p>\n<h4>Cestovn\u00ed n\u00e1hrady<\/h4>\n<p>S \u00fa\u010dinnost\u00ed od 1. ledna 2023 byla ve Sb\u00edrce z\u00e1kon\u016f zve\u0159ejn\u011bna pod \u010d. 401\/2022 Sb.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> vyhl\u00e1\u0161ka upravuj\u00edc\u00ed sazby zahrani\u010dn\u00edho stravn\u00e9ho pro rok 2023. Sazby zahrani\u010dn\u00edho stravn\u00e9ho pro rok 2023 byly zv\u00fd\u0161eny nap\u0159. pro Polsko na 45 EUR nebo pro \u0160v\u00e9dsko a D\u00e1nsko na 60 EUR. Celkem byly zm\u011bny provedeny u 25 zem\u00ed.<\/p>\n<p>Vnitrost\u00e1tn\u00ed cestovn\u00ed n\u00e1hrady byly ovlivn\u011bny vyhl\u00e1\u0161kou \u010d. 467\/2022 Sb.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> , kter\u00e1 zv\u00fd\u0161ila sazbu n\u00e1hrady za pou\u017eit\u00ed soukrom\u00e9ho vozidla na 5,20 K\u010d za 1 km j\u00edzdy. V\u00fd\u0161e tuzemsk\u00e9ho stravn\u00e9ho pak \u010din\u00ed od 1. ledna 2023:<\/p>\n<ul>\n<li>129 a\u017e 153 K\u010d, pokud pracovn\u00ed cesta trv\u00e1 5 a\u017e 12 hodin,<\/li>\n<li>196 a\u017e 236 K\u010d, pokud slu\u017eebn\u00ed cesta trv\u00e1 12 a\u017e 18 hodin,<\/li>\n<li>307 a\u017e 367 K\u010d, pokud pracovn\u00ed cesta trv\u00e1 18 hodin nebo d\u00e9le.<\/li>\n<\/ul>\n<p>Ceny pohonn\u00fdch hmot pro \u00fa\u010dely v\u00fdpo\u010dtu n\u00e1hrady za spot\u0159ebovan\u00e9 pohonn\u00e9 hmoty od 1. ledna 2023 jsou:<\/p>\n<ul>\n<li>41,20 K\u010d\/l BA 95,<\/li>\n<li>45,20 K\u010d\/l BA 98,<\/li>\n<li>44,10 K\u010d \/l NM,<\/li>\n<li>6 K\u010d\/kwh elekt\u0159iny.<\/li>\n<\/ul>\n<h4>Reduk\u010dn\u00ed hranice pro \u00fapravu denn\u00edho vym\u011b\u0159ovac\u00edho z\u00e1kladu pro \u00fa\u010dely nemocensk\u00e9ho poji\u0161t\u011bn\u00ed <u><a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/u><\/h4>\n<p>Tyto hodnoty reduk\u010dn\u00edch hranic pro rok 2023 jsou:<\/p>\n<ul>\n<li>1 345 K\u010d,<\/li>\n<li>2 017 K\u010d,<\/li>\n<li>4\u00a0033 K\u010d\u2024<\/li>\n<\/ul>\n<p>Tyto reduk\u010dn\u00ed hranice jsou d\u016fle\u017eit\u00e9 pro v\u00fdpo\u010det v\u00fd\u0161e n\u011bkolika d\u00e1vek soci\u00e1ln\u00edho zabezpe\u010den\u00ed, v\u010detn\u011b nemocensk\u00e9, mate\u0159sk\u00e9 a rychlosti \u010derp\u00e1n\u00ed rodi\u010dovsk\u00e9ho p\u0159\u00edsp\u011bvku.<\/p>\n<h4>Zv\u00fd\u0161en\u00ed \u010d\u00e1stky pro \u00fa\u010dast zam\u011bstnanc\u016f na nemocensk\u00e9m poji\u0161t\u011bn\u00ed<u> <a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/u><\/h4>\n<p>Ministerstvo pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed na z\u00e1klad\u011b z\u00e1konn\u00e9 regulace stanovilo limit v\u00fd\u0161e \u010d\u00e1stky rozhodn\u00e9 pro \u00fa\u010dast na nemocensk\u00e9m poji\u0161t\u011bn\u00ed od 1. ledna 2023 na 4 000 K\u010d.<\/p>\n<h3><\/h3>\n<h3><strong>Nejv\u00fdznamn\u011bj\u0161\u00ed zm\u011bny v posledn\u00ed dob\u011b<\/strong><\/h3>\n<h4>Sleva na soci\u00e1ln\u00edm poji\u0161t\u011bn\u00ed pro zam\u011bstnance na \u010d\u00e1ste\u010dn\u00fd \u00favazek <u><a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/u><\/h4>\n<p>S \u00fa\u010dinnost\u00ed od 1. \u00fanora 2023 m\u00e1 zam\u011bstnavatel podle z\u00e1kona \u010d. 216\/2022 Sb., kter\u00fdm se m\u011bn\u00ed z\u00e1kon o pojistn\u00e9m na soci\u00e1ln\u00ed zabezpe\u010den\u00ed a p\u0159\u00edsp\u011bvku na st\u00e1tn\u00ed politiku zam\u011bstnanosti, mo\u017enost uplatnit slevu na pojistn\u00e9m na soci\u00e1ln\u00ed zabezpe\u010den\u00ed za kalend\u00e1\u0159n\u00ed m\u011bs\u00edc za zam\u011bstnance v pracovn\u00edm nebo slu\u017eebn\u00edm pom\u011bru, kter\u00fd:<\/p>\n<ul>\n<li>je star\u0161\u00ed 55 let,<\/li>\n<li>pe\u010duje o d\u00edt\u011b mlad\u0161\u00ed 10 let, jeho\u017e je rodi\u010dem nebo kter\u00e9 je v p\u011bstounsk\u00e9 \u010di obdobn\u00e9 p\u00e9\u010di,<\/li>\n<li>pe\u010duje o bl\u00edzkou osobu mlad\u0161\u00ed 10 let, kter\u00e1 je z\u00e1visl\u00e1 na pomoci jin\u00e9 osoby,<\/li>\n<li>se z\u00e1rove\u0148 studiem p\u0159ipravuje na budouc\u00ed povol\u00e1n\u00ed,<\/li>\n<li>v posledn\u00edch 12 kalend\u00e1\u0159n\u00edch m\u011bs\u00edc\u00edch p\u0159ed kalend\u00e1\u0159n\u00edm m\u011bs\u00edcem, za kter\u00fd je po\u017eadov\u00e1no sn\u00ed\u017een\u00ed pojistn\u00e9ho, nastoupil na rekvalifikaci jako uchaze\u010d o zam\u011bstn\u00e1n\u00ed podle z\u00e1kona o zam\u011bstnanosti,<\/li>\n<li>je osobou se zdravotn\u00edm posti\u017een\u00edm podle z\u00e1kona o zam\u011bstnanosti, nebo<\/li>\n<li>je mlad\u0161\u00ed 21 let.<\/li>\n<\/ul>\n<p>Podm\u00ednkou je, \u017ee v\u00fd\u0161e uveden\u00e9 osoby maj\u00ed pracovn\u00ed smlouvu s krat\u0161\u00ed pracovn\u00ed nebo slu\u017eebn\u00ed dobou, ne\u017e je stanoven\u00e1 t\u00fddenn\u00ed pracovn\u00ed nebo slu\u017eebn\u00ed doba, \u00a0a to minim\u00e1ln\u011b 8 a maxim\u00e1ln\u011b 30 hodin t\u00fddn\u011b (s v\u00fdjimkou zam\u011bstnanc\u016f mlad\u0161\u00edch 21 let). V\u00fd\u0161e slevy \u010din\u00ed 5 % \u00fahrnu vym\u011b\u0159ovac\u00edch z\u00e1klad\u016f zam\u011bstnanc\u016f, na kter\u00e9 se sleva vztahuje. Sleva mus\u00ed b\u00fdt p\u0159edem ozn\u00e1mena a uplatn\u011bna na p\u0159edepsan\u00e9m tiskopise a lze ji uplatnit pouze do data splatnosti pojistn\u00e9ho za kalend\u00e1\u0159n\u00ed m\u011bs\u00edc, za kter\u00fd sleva n\u00e1le\u017e\u00ed.<\/p>\n<h4>Zv\u00fd\u0161en\u00ed n\u00e1hrady za ztr\u00e1tu na v\u00fdd\u011blku po pracovn\u00ed neschopnosti vznikl\u00e9 v d\u016fsledku pracovn\u00edho \u00farazu nebo nemoci z povol\u00e1n\u00ed <a href=\"#_ftn7\" name=\"_ftnref7\">[<\/a><u><a href=\"#_ftn7\" name=\"_ftnref7\">7]<\/a><\/u><\/h4>\n<p>Toto na\u0159\u00edzen\u00ed o \u00faprav\u011b n\u00e1hrady zv\u00fd\u0161ilo n\u00e1hradu za ztr\u00e1tu na v\u00fdd\u011blku po pracovn\u00ed neschopnosti nebo invalidit\u011b v d\u016fsledku pracovn\u00edho \u00farazu nebo nemoci z povol\u00e1n\u00ed s \u00fa\u010dinnost\u00ed od 1. ledna 2023.\u00a0 Do\u0161lo ke zv\u00fd\u0161en\u00ed o 5,1 % jak u po\u0161kozen\u00fdch zam\u011bstnanc\u016f, tak u poz\u016fstal\u00fdch, pokud byl zem\u0159el\u00fd zam\u011bstnancem. \u00daprava se t\u00fdk\u00e1 n\u00e1hrady za ztr\u00e1tu na v\u00fdd\u011blku a n\u00e1hrady n\u00e1klad\u016f na v\u00fd\u017eivu poz\u016fstal\u00fdch, kter\u00e9 se staly splatn\u00fdmi do 31. prosince 2022.<\/p>\n<h4>Zm\u011bna hygienick\u00fdch limit\u016f na pracovi\u0161ti <u><a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/u><\/h4>\n<p>Na\u0159\u00edzen\u00ed vl\u00e1dy \u010d. 303\/2022 Sb., kter\u00fdm se m\u011bn\u00ed na\u0159\u00edzen\u00ed \u010d. 361\/2007 Sb., kter\u00fdm se stanov\u00ed podm\u00ednky ochrany zdrav\u00ed p\u0159i pr\u00e1ci, reviduje minim\u00e1ln\u00ed po\u017eadavky na teplotu na pracovi\u0161ti s ohledem na v\u00e1le\u010dn\u00fd stav na Ukrajin\u011b, kv\u016fli kter\u00e9mu byly omezeny\/p\u0159eru\u0161eny dod\u00e1vky zemn\u00edho plynu. Vzhledem k nejistot\u011b, zda nedojde k prohlouben\u00ed energetick\u00e9 krize, stanovuje na\u0159\u00edzen\u00ed minim\u00e1ln\u00ed teplotu pro neklimatizovan\u00e1 pracovi\u0161t\u011b pro t\u0159\u00eddy pr\u00e1ce I a IIa a sni\u017euje minim\u00e1ln\u00ed teplotu pro v\u0161echny typy klimatizovan\u00fdch pracovi\u0161\u0165, kde se k vyt\u00e1p\u011bn\u00ed pou\u017e\u00edv\u00e1 klimatizace. Pro t\u0159\u00eddu pr\u00e1ce I a tepeln\u00fd odpor od\u011bvu 1,0 clo se minim\u00e1ln\u00ed teplota sni\u017euje z 22 \u00b0C na 18 \u00b0C. Pro t\u0159\u00eddu pr\u00e1ce II a tepeln\u00fd odpor od\u011bvu 1,0 se minim\u00e1ln\u00ed teplota sni\u017euje z 20 \u00b0C na 16 \u00b0C. Sou\u010dasn\u011b se sn\u00ed\u017eila teplota v \u0161atn\u00e1ch. Teplota v \u0161atn\u00e1ch se sn\u00ed\u017eila z 20 \u00b0C na 18 \u00b0C, v um\u00fdv\u00e1rn\u00e1ch z 22 \u00b0C na 19 \u00b0C, ve sprch\u00e1ch z 25 \u00b0C na 19 \u00b0C a na toalet\u00e1ch z 18 \u00b0C na 15 \u00b0C.<\/p>\n<p>Vyhl\u00e1\u0161kou \u010d. 304\/2022 Sb., kterou se m\u011bn\u00ed na\u0159\u00edzen\u00ed vl\u00e1dy \u010d. 6\/2003 Sb., se m\u011bn\u00ed stanoven\u00e9 hygienick\u00e9 limity chemick\u00fdch, fyzik\u00e1ln\u00edch a biologick\u00fdch ukazatel\u016f pro vnit\u0159n\u00ed prost\u0159ed\u00ed m\u00edstnost\u00ed n\u011bkter\u00fdch staveb. Mno\u017estv\u00ed vzduchu, kter\u00e9 m\u00e1 b\u00fdt odvedeno (odv\u011btr\u00e1no) za hodinu, je 30 m<sup>3<\/sup> na umyvadlo, 35-110 m<sup>3<\/sup> na sprchu a 50 m<sup>3<\/sup> na z\u00e1chod, pokud se jedn\u00e1 o m\u00edsu, a 25 m<sup>3<\/sup>, pokud se jedn\u00e1 o piso\u00e1r.<\/p>\n<p>Tyto zm\u011bny jsou \u00fa\u010dinn\u00e9 od 12. \u0159\u00edjna 2022.<\/p>\n<h4>Na\u0159\u00edzen\u00ed vl\u00e1dy o zm\u011bn\u00e1ch na\u0159\u00edzen\u00ed v oblasti pracovn\u00ed migrace <u><a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a><\/u><\/h4>\n<p>Na\u0159\u00edzen\u00ed vl\u00e1dy \u00fa\u010dinn\u00e9 od 1. listopadu 2022 p\u0159in\u00e1\u0161\u00ed zm\u011bny v oblasti pracovn\u00ed migrace. Na\u0159\u00edzen\u00ed zmoc\u0148uje vl\u00e1du ke stanoven\u00ed kv\u00f3t pro ekonomickou migraci z tzv. t\u0159et\u00edch zem\u00ed. Vl\u00e1da tak stanov\u00ed maxim\u00e1ln\u00ed po\u010det \u017e\u00e1dost\u00ed o v\u00edzum k pobytu nad 90 dn\u016f za \u00fa\u010delem podnik\u00e1n\u00ed, \u017e\u00e1dost\u00ed o povolen\u00ed k dlouhodob\u00e9mu pobytu za \u00fa\u010delem investov\u00e1n\u00ed a \u017e\u00e1dost\u00ed o zam\u011bstnaneckou kartu, kter\u00e9 lze podat v obdob\u00ed 1 roku v \u00fazemn\u00edm obvodu p\u0159\u00edslu\u0161n\u00e9ho zastupitelsk\u00e9ho \u00fa\u0159adu.<\/p>\n<h4>Ochrana otcovsk\u00e9 dovolen\u00e9 <a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/h4>\n<p>Z\u00e1konem \u010d. 358\/2022 Sb. se m\u011bn\u00ed z\u00e1kon o poskytov\u00e1n\u00ed d\u00e1vek osob\u00e1m se zdravotn\u00edm posti\u017een\u00edm, z\u00e1kon o st\u00e1tn\u00ed soci\u00e1ln\u00ed podpo\u0159e, z\u00e1kon o nemocensk\u00e9m poji\u0161t\u011bn\u00ed a dal\u0161\u00ed p\u0159edpisy z oblasti pr\u00e1ce a soci\u00e1ln\u00edho zabezpe\u010den\u00ed.<\/p>\n<p>Tato novela p\u0159in\u00e1\u0161\u00ed mimo jin\u00e9 zm\u011bny v oblasti z\u00e1kon\u00edku pr\u00e1ce a z\u00e1kona o nemocensk\u00e9m poji\u0161t\u011bn\u00ed. S \u00fa\u010dinnost\u00ed od 1. prosince <strong>se v\u00fdrazn\u011b roz\u0161i\u0159uj\u00ed <\/strong>n\u00e1roky souvisej\u00edc\u00ed s <strong>otcovskou poporodn\u00ed p\u00e9\u010d\u00ed<\/strong>. Otcov\u00e9, kte\u0159\u00ed do 1. prosince 2022 pob\u00edrali d\u00e1vky otcovsk\u00e9 poporodn\u00ed p\u00e9\u010de podle z\u00e1kona o nemocensk\u00e9m poji\u0161t\u011bn\u00ed, maj\u00ed v souvislosti s t\u011bmito d\u00e1vkami n\u00e1rok na rodi\u010dovskou dovolenou. N\u00e1rok v\u0161ak maj\u00ed pouze v p\u0159\u00edpad\u011b, \u017ee se d\u00edt\u011b narodilo \u017eiv\u00e9. Nyn\u00ed maj\u00ed n\u00e1rok na otcovskou dovolenou po dobu, po kterou pob\u00edrali d\u00e1vku podle z\u00e1kona o nemocensk\u00e9m poji\u0161t\u011bn\u00ed, a to i v p\u0159\u00edpad\u011b, \u017ee se d\u00edt\u011b narodilo mrtv\u00e9 nebo zem\u0159elo b\u011bhem \u0161estined\u011bl\u00ed.<\/p>\n<p>Z\u00e1rove\u0148 <strong>otcovsk\u00e1 dovolen\u00e1 z\u00edskala stejnou ochranu p\u0159ed okam\u017eit\u00fdm zru\u0161en\u00edm pracovn\u00edho pom\u011bru ze strany zam\u011bstnavatele jako v p\u0159\u00edpad\u011b mate\u0159sk\u00e9 dovolen\u00e9<\/strong>. Neposkytnut\u00ed otcovsk\u00e9 dovolen\u00e9 bude rovn\u011b\u017e sankcionov\u00e1no Inspekc\u00ed pr\u00e1ce stejn\u00fdm zp\u016fsobem jako neposkytnut\u00ed mate\u0159sk\u00e9 dovolen\u00e9, tj. pokutou a\u017e do v\u00fd\u0161e 500 000 K\u010d.<\/p>\n<p>Novela nov\u011b p\u0159id\u00e1v\u00e1 <strong>karant\u00e9nu <\/strong>jako d\u016fvod pro z\u00e1kaz v\u00fdpov\u011bdi podle z\u00e1kon\u00edku pr\u00e1ce. Na\u0159\u00edzen\u00ed karant\u00e9ny nyn\u00ed vede k p\u0159eru\u0161en\u00ed dovolen\u00e9 i nemocensk\u00e9. \u00da\u010dinnost tohoto ustanoven\u00ed je od 1. prosince 2022.<\/p>\n<p>Novela rovn\u011b\u017e zav\u00e1d\u00ed zv\u00fd\u0161en\u00ed p\u0159\u00edsp\u011bvku na mobilitu, zv\u00fd\u0161en\u00ed p\u0159\u00edsp\u011bvku na zvl\u00e1\u0161tn\u00ed pom\u016fcku a n\u011bkter\u00e9 dal\u0161\u00ed drobn\u00e9 zm\u011bny t\u00fdkaj\u00edc\u00ed se poh\u0159ebn\u00e9ho, voj\u00e1k\u016f z povol\u00e1n\u00ed atd.<\/p>\n<h4>Zru\u0161en\u00ed pravideln\u00fdch l\u00e9ka\u0159sk\u00fdch prohl\u00eddek <a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/h4>\n<p>V druh\u00e9 polovin\u011b prosince p\u0159edstavilo Ministerstvo zdravotnictv\u00ed novelu vyhl\u00e1\u0161ky \u010d. 79\/2013 Sb., o pracovn\u011bl\u00e9ka\u0159sk\u00fdch slu\u017eb\u00e1ch a n\u011bkter\u00fdch druz\u00edch posudkov\u00e9 p\u00e9\u010de, kter\u00e1 s \u00fa\u010dinnost\u00ed od 1. ledna 2023 ponech\u00e1v\u00e1 periodick\u00e9 pracovn\u011bl\u00e9ka\u0159sk\u00e9 prohl\u00eddky pro nerizikov\u00e1 povol\u00e1n\u00ed na dobrovolnosti. Zam\u011bstnavatel\u00e9 tak ji\u017e nebudou povinni tyto prohl\u00eddky zaji\u0161\u0165ovat, pokud se jedn\u00e1 o povol\u00e1n\u00ed, kter\u00e9 nen\u00ed rizikov\u00e9. Tato onemocn\u011bn\u00ed vznikaj\u00ed v d\u016fsledku t\u011b\u017ek\u00e9 fyzick\u00e9 pr\u00e1ce a struktury, kter\u00e9 jsou dlouhodob\u011b p\u0159et\u011b\u017eov\u00e1ny, vedou ke vzniku t\u011bchto onemocn\u011bn\u00ed.<\/p>\n<p>V souvislosti s t\u00edm se vl\u00e1da rozhodla zv\u00fd\u0161it od\u0161kodn\u011bn\u00ed za pracovn\u00ed \u00farazy.
