{"id":58166,"date":"2018-07-17T15:42:35","date_gmt":"2018-07-17T14:42:35","guid":{"rendered":"https:\/\/blogs.dlapiper.com\/iptitaly\/?p=58166"},"modified":"2019-06-24T11:42:35","modified_gmt":"2019-06-24T09:42:35","slug":"new-eprivacy-regulation-revision-proposal-and-blockchain-regulation-rush","status":"publish","type":"post","link":"https:\/\/blogs.dlapiper.com\/iptitaly\/2018\/07\/new-eprivacy-regulation-revision-proposal-and-blockchain-regulation-rush\/","title":{"rendered":"New ePrivacy regulation revision proposal and Blockchain regulation rush"},"content":{"rendered":"<p>The latest ePrivacy revision proposal brings relevant changes to the draft regulation and new Governments are joining the Blockchain regulation rush.<img decoding=\"async\" class=\" wp-image-58141 alignright\" src=\"https:\/\/blogs.dlapiper.com\/iptitaly\/files\/2018\/06\/Ricci-Fusion-Copy-212x300.jpg\" alt=\"\" width=\"121\" height=\"171\" srcset=\"https:\/\/blogs.dlapiper.com\/iptitaly\/files\/2018\/06\/Ricci-Fusion-Copy-212x300.jpg 212w, https:\/\/blogs.dlapiper.com\/iptitaly\/files\/2018\/06\/Ricci-Fusion-Copy.jpg 356w\" sizes=\"(max-width: 121px) 100vw, 121px\" \/><!--more--><\/p>\n<h2><strong>ePrivacy: latest revisions published by the EU Council<\/strong><\/h2>\n<p>On 10 July 2018 the Council of the European Union published the\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=consil:ST_10975_2018_INIT\">latest revision proposal<\/a>\u00a0of the\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/en\/TXT\/?uri=CELEX:52017PC0010\">draft ePrivacy Regulation<\/a>.<\/p>\n<p>The proposal introduces considerable changes compared to the\u00a0<a href=\"http:\/\/www.gamingtechlaw.com\/2017\/10\/eprivacy-regulation-libe-european-union.html\">previous version<\/a>\u00a0as<\/p>\n<ul>\n<li>Article 6 is amended to allow a further processing of electronic communications metadata not based on the end-user\u2019s consent, but with several conditions to be met;<\/li>\n<li>Article 10, which provided for the possibility to use browser setting for cookie consent, is deleted and<\/li>\n<li>Article 8 is better clarified providing that access to specific website content may still be made conditional on the consent to the storage of a cookie or similar identifier.<\/li>\n<\/ul>\n<p>The revisions will be discussed in a\u00a0<a href=\"https:\/\/www.parlament.gv.at\/PAKT\/EU\/XXVI\/EU\/02\/99\/EU_29915\/imfname_10827441.pdf\">WP TELE meeting on 17 July 2018<\/a>.<\/p>\n<p>After the #GDPR hype, the ePrivacy Regulation is the next big thing in the privacy scene as it covers the confidentiality of electronic communications, thus having a wider field of application including non-personal data\u00a0such as M2M and IoT data.<\/p>\n<p>The impact this new ePrivacy Regulation will have on existing business models and digital markets is impressive and the legislative train should be carefully monitored in order to intercept its route since, as this new proposal shows, it can change rapidly.<\/p>\n<h2><strong>Blockchain: worldwide regulation rush already beyond the starting line<\/strong><\/h2>\n<p>The\u00a0<a href=\"http:\/\/www.gamingtechlaw.com\/2016\/05\/liability-blockchain.html\">blockchain\u00a0<\/a>is exponentially gaining credit during this 2018 summer obtaining official recognition in legal frameworks all over the world.<\/p>\n<p>After the\u00a0first local blockchain-based test vote\u00a0in Zug, SIX, the owner and operator of the Swiss stock exchange\u00a0announced\u00a0its plans to launch a fully-regulated platform for trading digital assets using blockchain. Meanwhile South Korean government is\u00a0reportedly\u00a0going to to produce the final draft of a new blockchain industry classificatory scheme by the end of July, recognizing crypto exchanges as regulated financial institutions. On the other side of the world, the Maltese Parliament recently approved three bills, including\u00a0the Virtual Financial Asset act, establishing a regulatory framework for blockchain technology.<\/p>\n<p>This regulation rush clearly shows that States are competing worldwide to become the next \u00a0hotspot for blockchain and cryptocurrency companies giving them the tools necessary
