Consultation on the draft RTS closed last week. The RTS was rather vague when it came to providing any practical tests on this. The criterion is that potential investors should be able to analyse a pool’s assets on a consistent basis. AFME has suggested that originators could reasonably select which characteristics were relevant. DLA Piper put its own suggestions to the EBA, and suggested some examples be published. This is not a political issue. We understand that the EBA is currently overloaded with work, so it is unclear how fast or much this will move.
