Az \u00faj szab\u00e1lyoz\u00e1s \u2013 sz\u00e1mos m\u00e1s \u00fajdons\u00e1g mellett \u2013 lehet\u0151v\u00e9 teszi, hogy a k\u00f6z\u00f6s tulajdon haszn\u00e1lat\u00e1ra vonatkoz\u00f3 jogot bejegyeztethess\u00fck az ingatlan-nyilv\u00e1ntart\u00e1sba, amely n\u00f6velheti a k\u00f6z\u00f6s tulajdonban \u00e1ll\u00f3 ingatlan forgalmi \u00e9rt\u00e9k\u00e9t \u00e9s megk\u00f6nny\u00edtheti a banki finansz\u00edroz\u00e1s ig\u00e9nybev\u00e9tel\u00e9t is. Az eddigiekben ennek k\u00f6zhiteles nyilv\u00e1ntart\u00e1sba t\u00f6rt\u00e9n\u0151 bejegyz\u00e9s\u00e9re nem volt lehet\u0151s\u00e9g. Ennek megfelel\u0151en a haszn\u00e1lati meg\u00e1llapod\u00e1s megk\u00f6t\u00e9s\u00e9nek t\u00e9nye nem der\u00fclt ki az ingatlan-nyilv\u00e1ntart\u00e1si adatokb\u00f3l. Tipikus volt hasonl\u00f3 meg\u00e1llapod\u00e1sok megk\u00f6t\u00e9se ikerh\u00e1zak, illetve egy\u00e9b k\u00f6z\u00f6s tulajdonban \u00e1ll\u00f3 ingatlanok vonatkoz\u00e1s\u00e1ban, k\u00fcl\u00f6n\u00f6sen azokban az esetekben, amelyekben a tulajdonost\u00e1rsak b\u00e1rmelyike banki finansz\u00edroz\u00e1st vett ig\u00e9nybe. A k\u00f6z\u00f6s tulajdonban \u00e1ll\u00f3 ingatlanok eset\u00e9ben ugyanis a legt\u00f6bb kereskedelmi bank a hitelszerz\u0151d\u00e9s megk\u00f6t\u00e9s\u00e9nek felt\u00e9tel\u00e9\u00fcl szabta a tulajdonost\u00e1rsak k\u00f6z\u00f6tti haszn\u00e1lati megoszt\u00e1si szerz\u0151d\u00e9s megk\u00f6t\u00e9s\u00e9t. \u00a0\u00a0<\/p><p>A jogalkot\u00f3 felismerve a t\u00e9nyleges gyakorlat \u00e9s az ingatlan-nyilv\u00e1ntart\u00e1sba bejegyeztethet\u0151 jogok k\u00f6z\u00f6tti jelent\u0151s elt\u00e9r\u00e9seket, az \u00daj Inyvhr. 20. \u00a7 24. pontj\u00e1ban k\u00fcl\u00f6n neves\u00edtett m\u00f3don megteremtette a lehet\u0151s\u00e9g\u00e9t annak, hogy a k\u00f6z\u00f6s tulajdon haszn\u00e1lat\u00e1ra vonatkoz\u00f3 jog az ingatlan-nyilv\u00e1ntart\u00e1sba bejegyz\u00e9sre ker\u00fclj\u00f6n. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-5d5dbd8 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"5d5dbd8\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-5711a46\" data-id=\"5711a46\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-8e4d48b elementor-widget elementor-widget-text-editor\" data-id=\"8e4d48b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h5><strong>Milyen ingatlanok eset\u00e9ben van lehet\u0151s\u00e9g k\u00f6z\u00f6s tulajdon haszn\u00e1lat\u00e1ra vonatkoz\u00f3 jog bejegyz\u00e9s\u00e9re?<\/strong><\/h5>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-212cd29 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"212cd29\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-f88724a\" data-id=\"f88724a\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-f4e3bbc elementor-widget elementor-widget-text-editor\" data-id=\"f4e3bbc\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Az \u00e9rintett ingatlannak \u00e9rtelemszer\u0171en a tulajdonost\u00e1rsak k\u00f6z\u00f6s tulajdon\u00e1ban kell \u00e1llnia, valamint csak olyan ingatlan eset\u00e9ben lehets\u00e9ges e jog bejegyz\u00e9se, amely nem min\u0151s\u00fcl mez\u0151- \u00e9s erd\u0151gazdas\u00e1gi hasznos\u00edt\u00e1s\u00fa f\u00f6ldnek.<\/p><p>A k\u00f6z\u00f6s tulajdon haszn\u00e1lat\u00e1ra vonatkoz\u00f3 jogot be lehet jegyezni k\u00f6z\u00f6s tulajdonban \u00e1ll\u00f3 eg\u00e9sz ingatlanra, eg\u00e9sz tulajdoni illet\u0151s\u00e9gre vagy ak\u00e1r ezek eszmei h\u00e1nyad\u00e1ra. Nincs akad\u00e1lya tov\u00e1bb\u00e1 annak sem, hogy t\u00e1rsash\u00e1zi ingatlanra ker\u00fclj\u00f6n a k\u00f6z\u00f6s tulajdon haszn\u00e1lat\u00e1ra vonatkoz\u00f3 jog bejegyz\u00e9sre. A k\u00f6z\u00f6s tulajdon haszn\u00e1lat\u00e1ra vonatkoz\u00f3 jogot vagy az ingatlan term\u00e9szetben meghat\u00e1rozott r\u00e9sz\u00e9re (p\u00e9ld\u00e1ul az ingatlanon tal\u00e1lhat\u00f3 egyes \u00e9p\u00fcletekre), vagy annak egy ter\u00fcletnagys\u00e1gban kifejezett r\u00e9sz\u00e9re lehet alap\u00edtani (p\u00e9ld\u00e1ul n\u00e9gyzetm\u00e9terben megadva). \u00a0Arra a gyakorlati k\u00e9rd\u00e9sre, mely szerint sz\u00fcks\u00e9ges-e z\u00e1rad\u00e9kolt v\u00e1zrajzot is beny\u00fajtani az elj\u00e1r\u00e1s sor\u00e1n, maga az \u00daj Inyvhr. adja meg a v\u00e1laszt. Az ingatlan term\u00e9szetben meghat\u00e1rozott vagy ter\u00fcletnagys\u00e1gban kifejezett r\u00e9sz\u00e9re vonatkoz\u00f3 b\u00e1rmely jog bejegyz\u00e9s\u00e9hez ugyanis az ingatlan \u00e9rintett r\u00e9sz\u00e9t \u00e1br\u00e1zol\u00f3 \u00e9s az ingatlan\u00fcgyi hat\u00f3s\u00e1g \u00e1ltal \u00e9rv\u00e9nyes z\u00e1rad\u00e9kkal ell\u00e1tott v\u00e1ltoz\u00e1si v\u00e1zrajz sz\u00fcks\u00e9ges. Ez a szab\u00e1ly vonatkozik a k\u00f6z\u00f6s tulajdon haszn\u00e1lat\u00e1ra vonatkoz\u00f3 jog ingatlan-nyilv\u00e1ntart\u00e1si bejegyz\u00e9s\u00e9re is. Ugyanakkor elk\u00e9pzelhet\u0151ek olyan egy\u00e9b megoszt\u00e1si lehet\u0151s\u00e9gek is, amelyek eset\u00e9ben nem sz\u00fcks\u00e9ges v\u00e1ltoz\u00e1si v\u00e1zrajz beny\u00fajt\u00e1sa. Ilyen lehet az id\u0151beli megoszt\u00e1sra ir\u00e1nyul\u00f3 meg\u00e1llapod\u00e1s, amely alapj\u00e1n p\u00e9ld\u00e1ul az egyik tulajdonost\u00e1rs az \u00e9v els\u0151 fel\u00e9ben, m\u00edg a m\u00e1sik tulajdonost\u00e1rs az \u00e9v m\u00e1sodik fel\u00e9ben haszn\u00e1lhatja a k\u00f6z\u00f6s tulajdonukban \u00e1ll\u00f3 ingatlant. A bejegyz\u00e9sben fel kell t\u00fcntetni a megoszt\u00e1s t\u00e9rbeli vagy id\u0151beli jelleg\u00e9t, valamint a haszn\u00e1lati jog l\u00e9trej\u00f6tt\u00e9nek alapj\u00e1ul szolg\u00e1l\u00f3 okiratot. Ut\u00f3bbi az al\u00e1bbi okiratok valamelyike lehet:<\/p><p>\u00a0 \u00a0 \u00a0 \u00a0 a) a felek egyhang\u00fa meg\u00e1llapod\u00e1sa vagy hat\u00e1rozata<\/p><p><span style=\"font-size: 16px;background-color: var(--ast-global-color-5)\">\u00a0 \u00a0 \u00a0 \u00a0 b) a felek sz\u00f3t\u00f6bbs\u00e9ges hat\u00e1rozata<\/span><\/p><p><span style=\"font-size: 16px;background-color: var(--ast-global-color-5)\">\u00a0 \u00a0 \u00a0 \u00a0 c) b\u00edr\u00f3s\u00e1gi hat\u00e1rozat<\/span><\/p><p><span style=\"font-size: 16px;background-color: var(--ast-global-color-5)\">\u00a0 \u00a0 \u00a0 \u00a0 d) t\u00e1rsash\u00e1z alap\u00edt\u00f3 okirata<\/span><\/p><p>A fentiek \u00e9rtelm\u00e9ben teh\u00e1t nem kell felt\u00e9tlen\u00fcl a tulajdonost\u00e1rsak teljes egyet\u00e9rt\u00e9se a k\u00f6z\u00f6s tulajdon haszn\u00e1lat\u00e1ra vonatkoz\u00f3 jog megalap\u00edt\u00e1s\u00e1hoz.
