Mindez azt jelenti, hogy egy napelempark l\u00e9tes\u00edt\u00e9se eset\u00e9n a beruh\u00e1z\u00f3 c\u00e9g kiz\u00e1r\u00f3lag azt k\u00f6vet\u0151en szeretheti meg az \u00e9rintett term\u0151f\u00f6ld tulajdonjog\u00e1t, illetve annak a beruh\u00e1z\u00e1ssal \u00e9rintett ter\u00fclet\u00e9re vonatkoz\u00f3 tulajdonjogot, ha annak term\u0151f\u00f6ld jellege m\u00e1r megsz\u0171nt, vagyis az ingatlant \u00e1tmin\u0151s\u00edtett\u00e9k \u00e9s m\u00e1r nem term\u0151f\u00f6ldk\u00e9nt szerepel az ingatlan-nyilv\u00e1ntart\u00e1sban. Az ingatlan-nyilv\u00e1ntart\u00e1si \u00e1tmin\u0151s\u00edt\u00e9snek el\u0151felt\u00e9tele a m\u00e1s c\u00e9l\u00fa hasznos\u00edt\u00e1si enged\u00e9ly alapj\u00e1n a m\u00e1s c\u00e9l\u00fa hasznos\u00edt\u00e1s megval\u00f3s\u00edt\u00e1sa \u2013 vagyis eset\u00fcnkben a naper\u0151m\u0171 fel\u00e9p\u00edt\u00e9se \u2013, ez\u00e9rt az \u00e1tmin\u0151s\u00edt\u00e9sre a gyakorlatban a beruh\u00e1z\u00e1s v\u00e9g\u00e9n, a haszn\u00e1latbav\u00e9teli enged\u00e9ly kiad\u00e1s\u00e1t k\u00f6vet\u0151en ker\u00fclhet sor. Mindez azt is jelenti, hogy a beruh\u00e1z\u00e1s jelent\u0151s k\u00f6lts\u00e9gig\u00e9ny\u0171 el\u0151k\u00e9sz\u00edt\u00e9s\u00e9re, enged\u00e9lyeztet\u00e9s\u00e9re \u00e9s kivitelez\u00e9s\u00e9re m\u00e9g m\u00e1s tulajdon\u00e1ban \u00e1ll\u00f3 ingatlanon ker\u00fcl sor. Sokkal szorosabb egy\u00fcttm\u0171k\u00f6d\u00e9s sz\u00fcks\u00e9ges teh\u00e1t a tulajdonos \u00e9s a beruh\u00e1z\u00f3 k\u00f6z\u00f6tt az enged\u00e9lyeztet\u00e9s \u00e9s a megval\u00f3s\u00edt\u00e1s sor\u00e1n, valamint a kivitelez\u00e9s \u00e9s k\u00e9s\u0151bb a tulajdonjog biztos\u00edt\u00e1s\u00e1ra megfelel\u0151 biztos\u00edt\u00e9kokra van sz\u00fcks\u00e9g. Milyen jogi eszk\u00f6z\u00f6k v\u00e9dhetik ebben az esetben a beruh\u00e1z\u00f3t?<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cd8e620 elementor-widget elementor-widget-heading\" data-id=\"cd8e620\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Kivitelez\u00e9s m\u00e1s tulajdon\u00e1ban \u00e1ll\u00f3 ingatlanon \u2013 \u00e9p\u00edtm\u00e9nyi jog kontra f\u00f6ldhaszn\u00e1lati jog<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-836ab4c elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"836ab4c\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-e24b0b7\" data-id=\"e24b0b7\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-a1c798a elementor-widget elementor-widget-text-editor\" data-id=\"a1c798a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Mivel m\u00e1s tulajdon\u00e1ban \u00e1ll\u00f3 ingatlanon ker\u00fclhet sor a kivitelez\u00e9sre, ez\u00e9rt az \u00e9p\u00edtkez\u00e9s megkezd\u00e9s\u00e9hez (\u00e9s term\u00e9szetesen m\u00e1r az enged\u00e9lyeztet\u00e9shez is) el\u0151zetesen meg\u00e1llapod\u00e1st kell k\u00f6tni az ingatlan tulajdonos\u00e1val. A beruh\u00e1z\u00f3 \u00e9rdeke, hogy a meg\u00e1llapod\u00e1s ingatlan-nyilv\u00e1ntart\u00e1sba is bejegyz\u00e9sre ker\u00fclj\u00f6n, \u00edgy ez\u00e1ltal a k\u00f6vetkez\u0151 tulajdonost\/harmadik f\u00e9l jogszerz\u0151t is k\u00f6sse. Ennek elmarad\u00e1sa eset\u00e9n a meg\u00e1llapod\u00e1s csak az aktu\u00e1lis tulajdonosra n\u00e9zve k\u00f6telmi hat\u00e1ly\u00fa. A naper\u0151m\u0171 fejleszt\u00e9sek vonatkoz\u00e1s\u00e1ban ingatlan-nyilv\u00e1ntart\u00e1sba csak az \u00e9p\u00edtm\u00e9nyi jog \u00e9s az \u00e9p\u00edt\u00e9si c\u00e9l\u00fa f\u00f6ldhaszn\u00e1lati jog ker\u00fclhet, amelyeken t\u00fal az alapul fekv\u0151 meg\u00e1llapod\u00e1s is beny\u00fajt\u00e1sra ker\u00fcl. Ennek jelent\u0151s\u00e9ge, hogy ez\u00e1ltal a meg\u00e1llapod\u00e1s tartalma minden \u00e9rintett sz\u00e1m\u00e1ra hozz\u00e1f\u00e9rhet\u0151v\u00e9 v\u00e1lik \u00e9s harmadik f\u00e9l ut\u00f3bb \u00e9rdemben nem hivatkozhat arra, hogy nem tudott a bejegyzett jogr\u00f3l, valamint az alapul fekv\u0151 szerz\u0151d\u00e9sben foglalt meg\u00e1llapod\u00e1s r\u00e9szletes tartalm\u00e1r\u00f3l.<\/p><p>A Polg\u00e1ri T\u00f6rv\u00e9nyk\u00f6nyv 2023. j\u00fanius 24-i hat\u00e1llyal hozta be a hazai jogba az \u00e9p\u00edtm\u00e9nyi jogi int\u00e9zm\u00e9ny\u00e9t. Ezt megel\u0151z\u0151en a napelempark beruh\u00e1z\u00e1sok jellemz\u0151en \u00e9p\u00edt\u00e9si c\u00e9l\u00fa f\u00f6ldhaszn\u00e1lati jog bejegyz\u00e9se alapj\u00e1n l\u00e9tes\u00fclhettek. Az \u00e9p\u00edtm\u00e9nyi jog bevezet\u00e9s\u00e9t hatalmas \u00e9rdekl\u0151d\u00e9s \u00f6vezte beruh\u00e1z\u00f3i oldalon, azonban a bizonytalan jogszab\u00e1lyi k\u00f6rnyezet miatt az \u00e9p\u00edtm\u00e9nyi jog bevezet\u00e9s\u00e9nek gyakorlati jelent\u0151s\u00e9ge egyel\u0151re elmaradt a v\u00e1rakoz\u00e1sokt\u00f3l. A jelenleg hat\u00e1lyban l\u00e9v\u0151 rendelkez\u00e9sek szerint ugyanis az \u00e9p\u00edtm\u00e9nyi jog megalap\u00edt\u00e1sa olyan hossz\u00fa id\u0151t\u00e1vra sz\u00f3l\u00f3, komoly megfontol\u00e1st ig\u00e9nyl\u0151 d\u00f6nt\u00e9s, amely fogyaszt\u00f3t\u00f3l nem v\u00e1rhat\u00f3 el, \u00edgy az nem is alap\u00edthat \u00e9p\u00edtm\u00e9nyi jogot. K\u00e9rd\u00e9st vet fel azonban, hogy ki min\u0151s\u00fcl fogyaszt\u00f3nak? Fogyaszt\u00f3 az a term\u00e9szetes szem\u00e9ly, aki a szakm\u00e1ja, \u00f6n\u00e1ll\u00f3 foglalkoz\u00e1sa vagy \u00fczleti tev\u00e9kenys\u00e9ge k\u00f6r\u00e9n k\u00edv\u00fcl j\u00e1r el, erre tekintettel vizsg\u00e1land\u00f3, hogy a term\u0151f\u00f6ld tulajdonosa fogyaszt\u00f3nak min\u0151s\u00fcl-e vagy sem. Ha a term\u0151f\u00f6ld tulajdonosa f\u00f6ldm\u0171ves, akkor a term\u0151f\u00f6ld ilyen c\u00e9l\u00fa hasznos\u00edt\u00e1sa nem tartozik egy\u00e9rtelm\u0171en a f\u00f6ldm\u0171ves \u00fczleti tev\u00e9kenys\u00e9g\u00e9nek k\u00f6r\u00e9be, hiszen az nem mez\u0151gazdas\u00e1gi tev\u00e9kenys\u00e9g, de a f\u00f6ldm\u0171ves kieg\u00e9sz\u00edt\u0151 tev\u00e9kenys\u00e9ge al\u00e1 tartozhat. Ennek oka, hogy a kieg\u00e9sz\u00edt\u0151 tev\u00e9kenys\u00e9g jogszab\u00e1lyi meghat\u00e1roz\u00e1s\u00e1ban szerepel a mez\u0151gazdas\u00e1gi \u00fczemhez tartoz\u00f3 termel\u00e9si t\u00e9nyez\u0151k hasznos\u00edt\u00e1sa, \u00e9rt\u00e9kes\u00edt\u00e9se \u2013 mely jelen esetben a term\u0151f\u00f6ld hasznos\u00edt\u00e1s\u00e1t jelentheti. Ha pedig kieg\u00e9sz\u00edt\u0151 tev\u00e9kenys\u00e9gnek min\u0151s\u00fcl az \u00e9p\u00edtm\u00e9nyi jog alap\u00edt\u00e1sa, akkor nem fogyaszt\u00f3k\u00e9nt j\u00e1r el a f\u00f6ldm\u0171ves, teh\u00e1t jogosult lehet \u00e9p\u00edtm\u00e9nyi jog alap\u00edt\u00e1s\u00e1ra. Mindazon\u00e1ltal ez olyan jog\u00e9rtelmez\u00e9si k\u00e9rd\u00e9s, amelyre egyel\u0151re a b\u00edr\u00f3i gyakorlat m\u00e9g nem adott v\u00e1laszt. Ha pedig az \u00e9rintett term\u0151f\u00f6ld tulajdonosa nem f\u00f6ldm\u0171ves mag\u00e1nszem\u00e9ly, akkor egy\u00e9rtelm\u0171en fogyaszt\u00f3nak min\u0151s\u00fcl \u00e9s ebben az esetben fel sem mer\u00fcl annak a lehet\u0151s\u00e9ge, hogy \u00e9p\u00edtm\u00e9nyi jogot alap\u00edthasson a fenti korl\u00e1toz\u00e1sra tekintettel.<\/p><p>A fenti \u00e9rtelmez\u00e9sb\u0151l fakad\u00f3 bizonytalans\u00e1gra \u00e9s kock\u00e1zatokra tekintettel \u2013 tov\u00e1bb\u00e1 az\u00e9rt is, mert az \u00e9p\u00edt\u00e9si c\u00e9l\u00fa f\u00f6ldhaszn\u00e1lati jog alap\u00edt\u00e1sa m\u00e1r \u00f6nmag\u00e1ban is megfelel\u0151 \u00e9s sz\u00e9lesk\u00f6r\u0171en alkalmazott biztos\u00edt\u00e9kot jelent a beruh\u00e1z\u00f3k sz\u00e1m\u00e1ra \u2013 az \u00e9p\u00edtm\u00e9nyi jog bevezet\u00e9se \u00f3ta tov\u00e1bbra is azt mutatj\u00e1k gyakorlati tapasztalataink, hogy a beruh\u00e1z\u00f3k az \u00e9p\u00edt\u00e9si c\u00e9l\u00fa f\u00f6ldhaszn\u00e1lati meg\u00e1llapod\u00e1sokat haszn\u00e1lj\u00e1k jogaik megfelel\u0151 biztos\u00edt\u00e1s\u00e1ra a m\u00e1s tulajdon\u00e1ban \u00e1ll ingatlanokon v\u00e9gzett naper\u0151m\u0171 beruh\u00e1z\u00e1sok sor\u00e1n. Term\u00e9szetesen a beruh\u00e1z\u00e1s megval\u00f3s\u00edt\u00e1s\u00e1nak idej\u00e9re, illetve az \u00fczemeltet\u00e9s id\u0151szak\u00e1ra tov\u00e1bbi biztos\u00edt\u00e9kok alap\u00edt\u00e1sa is indokolt lehet, amelynek t\u00e1rgyal\u00e1s\u00e1ra a cikksorozatunk k\u00f6vetkez\u0151 r\u00e9sz\u00e9ben ker\u00edt\u00fcnk sort.<\/p><p><i>Szerz\u0151: Sz\u0171cs
