Az \u00fcgyek h\u00e1ttere<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-e2193ff elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"e2193ff\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-16b9664\" data-id=\"16b9664\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-72cdc49 elementor-widget elementor-widget-text-editor\" data-id=\"72cdc49\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A B\u00edr\u00f3s\u00e1g el\u0151zetes d\u00f6nt\u00e9shozatali elj\u00e1r\u00e1s keretei k\u00f6z\u00f6tt \u00e9rtelmezte a t\u00e9nyleges tulajdonosi nyilv\u00e1ntart\u00e1sok szempontj\u00e1b\u00f3l relev\u00e1ns ir\u00e1nyelvi (ti. 2015\/849 ir\u00e1nyelv, a 2018\/843 ir\u00e1nyelv \u00e9s a m\u00f3dos\u00edtott 2015\/849 ir\u00e1nyelv) rendelkez\u00e9sek, valamint az uni\u00f3s alapjogi rendelkez\u00e9seinek \u00f6sszhangj\u00e1t.<\/p><p>A k\u00e9relmeket egyr\u00e9szt a WM \u00e9s a Luxembourg Business Registers (a tov\u00e1bbiakban: LBR) k\u00f6z\u00f6tt (C\u201137\/20. sz. \u00fcgy)<a name=\"_ftnref1\"><\/a><a href=\"https:\/\/blogs.dlapiper.com\/advocatus\/2022\/12\/vege-a-tenyleges-tulajdonosi-nyilvantartasok-nyilvanossaganak\/#hivatkozas\">[1]<\/a>, m\u00e1sr\u00e9szt pedig a Sovim SA \u00e9s az LBR (C\u2011601\/20. sz. \u00fcgy)<a name=\"_ftnref2\"><\/a><a href=\"https:\/\/blogs.dlapiper.com\/advocatus\/2022\/12\/vege-a-tenyleges-tulajdonosi-nyilvantartasok-nyilvanossaganak\/#hivatkozas\">[2]<\/a>\u00a0k\u00f6z\u00f6tt folyamatban l\u00e9v\u0151 elj\u00e1r\u00e1sban terjesztett\u00e9k el\u0151. Az elj\u00e1r\u00e1s t\u00e1rgya az volt, hogy az LBR nem akad\u00e1lyozta meg a lakoss\u00e1gnak egyr\u00e9szt WM \u2013 egy ingatlannal foglalkoz\u00f3 t\u00e1rsas\u00e1gban fenn\u00e1ll\u00f3 \u2013 t\u00e9nyleges tulajdonosi min\u0151s\u00e9g\u00e9re, m\u00e1sr\u00e9szt a Sovim SA t\u00e9nyleges tulajdonos\u00e1ra vonatkoz\u00f3 inform\u00e1ci\u00f3khoz val\u00f3 hozz\u00e1f\u00e9r\u00e9s\u00e9t.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-5787878 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"5787878\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-fc08500\" data-id=\"fc08500\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-f96b80c elementor-widget elementor-widget-text-editor\" data-id=\"f96b80c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>2. A B\u00edr\u00f3s\u00e1g d\u00f6nt\u00e9se<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-38d8dad elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"38d8dad\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-ab5a9d8\" data-id=\"ab5a9d8\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-de6e240 elementor-widget elementor-widget-text-editor\" data-id=\"de6e240\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A B\u00edr\u00f3s\u00e1g az al\u00e1bbi \u00e9rvek ment\u00e9n \u00e1llap\u00edtotta meg a t\u00e9nyleges tulajdonosi nyilv\u00e1ntart\u00e1sok nyilv\u00e1noss\u00e1ga (azaz b\u00e1rki \u00e1ltal el\u00e9rhet\u0151 jelleg\u00fck) \u00e9rv\u00e9nytelens\u00e9g\u00e9t.<\/p><p>A m\u00f3dos\u00edtott 2015\/849 ir\u00e1nyelv 30. cikk\u00e9nek 2. mondata arra k\u00f6telezi a tag\u00e1llamokat, hogy biztos\u00edts\u00e1k, hogy a t\u00e9nyleges tulajdonosokra vonatkoz\u00f3 inform\u00e1ci\u00f3k (azaz \u201e<strong><em>minim\u00e1lisan<\/em><\/strong><em> a t\u00e9nyleges tulajdonos neve, sz\u00fclet\u00e9si \u00e9ve \u00e9s h\u00f3napja, a tart\u00f3zkod\u00e1si helye szerinti orsz\u00e1g neve \u00e9s a t\u00e9nyleges tulajdonos \u00e1llampolg\u00e1rs\u00e1ga, valamint a t\u00e9nyleges tulajdonosi \u00e9rdekelts\u00e9g jelleg\u00e9re \u00e9s m\u00e9rt\u00e9k\u00e9re vonatkoz\u00f3 adatok<\/em>\u201d) minden esetben el\u00e9rhet\u0151ek legyenek \u201e<strong>a lakoss\u00e1g b\u00e1rmely tagja<\/strong>\u201d sz\u00e1m\u00e1ra.<\/p><p>A B\u00edr\u00f3s\u00e1g lesz\u00f6gezte, hogy a nyilv\u00e1nos hozz\u00e1f\u00e9r\u00e9s lehet\u0151v\u00e9 teheti a <strong>profilalkot\u00e1st<\/strong> az \u00e9rintett szem\u00e9ly vagyoni helyzete, valamint azon konkr\u00e9t gazdas\u00e1gi \u00e1gazatok, orsz\u00e1gok \u00e9s v\u00e1llalkoz\u00e1sok tekintet\u00e9ben, amelyekben vagy amelyekbe az \u00e9rintett szem\u00e9ly befektetett. A B\u00edr\u00f3s\u00e1g tov\u00e1bb\u00e1 r\u00f6gz\u00edtette, hogy ezen inform\u00e1ci\u00f3knak a lakoss\u00e1g sz\u00e1m\u00e1ra t\u00f6rt\u00e9n\u0151 hozz\u00e1f\u00e9rhet\u0151v\u00e9 t\u00e9tel\u00e9vel egy\u00fctt j\u00e1r, hogy ezek az inform\u00e1ci\u00f3k <strong>potenci\u00e1lisan korl\u00e1tlan sz\u00e1m\u00fa szem\u00e9ly sz\u00e1m\u00e1ra v\u00e1lnak el\u00e9rhet\u0151v\u00e9<\/strong>, \u00e9s ez\u00e9rt olyan szem\u00e9lyek sz\u00e1m\u00e1ra is lehet\u0151v\u00e9 teheti a fenti adatokhoz val\u00f3 szabad hozz\u00e1f\u00e9r\u00e9st, akik az eredeti c\u00e9lt\u00f3l (ti. a p\u00e9nzmos\u00e1s \u00e9s a terrorizmusfinansz\u00edroz\u00e1s megel\u0151z\u00e9se) elt\u00e9r\u0151 c\u00e9lb\u00f3l k\u00edv\u00e1nnak a t\u00e9nyleges tulajdonosok t\u00f6bbek k\u00f6z\u00f6tt anyagi \u00e9s p\u00e9nz\u00fcgyi helyzet\u00e9r\u0151l t\u00e1j\u00e9koz\u00f3dni. A hozz\u00e1f\u00e9r\u00e9s eredm\u00e9nyek\u00e9nt a k\u00e9rd\u00e9ses adatok meg is \u0151rizhet\u0151k \u00e9s terjeszthet\u0151k, amely lehet\u0151v\u00e9 teheti az \u00e9rintett szem\u00e9lyes adatok vissza\u00e9l\u00e9sszer\u0171 felhaszn\u00e1l\u00e1s\u00e1t is.<\/p><p>A B\u00edr\u00f3s\u00e1g meg\u00e1llap\u00edt\u00e1sa szerint, tekintettel arra, hogy a fenti adatok azonos\u00edtott term\u00e9szetes szem\u00e9lyekre, a tag\u00e1llamok ter\u00fclet\u00e9n bejegyzett t\u00e1rsas\u00e1gok \u00e9s m\u00e1s jogi entit\u00e1sok t\u00e9nyleges tulajdonosaira vonatkoz\u00f3 inform\u00e1ci\u00f3kat tartalmaznak, a lakoss\u00e1g b\u00e1rmely tagj\u00e1nak ezen inform\u00e1ci\u00f3khoz val\u00f3 hozz\u00e1f\u00e9r\u00e9se az Eur\u00f3pai Uni\u00f3 Alapjogi Chart\u00e1j\u00e1nak (a tov\u00e1bbiakban: Charta) 7. cikk\u00e9ben biztos\u00edtott, <strong>a mag\u00e1n\u00e9let tiszteletben tart\u00e1s\u00e1hoz, <\/strong>valamint a Charta 8. cikk\u00e9ben biztos\u00edtott <strong>szem\u00e9lyes adatok v\u00e9delm\u00e9hez f\u0171z\u0151d\u0151 alapvet\u0151 jogokba val\u00f3 s\u00falyos beavatkoz\u00e1snak min\u0151s\u00fcl<\/strong>, k\u00fcl\u00f6n\u00f6sen az\u00e9rt, mert \u00a0a hozz\u00e1f\u00e9r\u00e9si lehet\u0151s\u00e9g <strong>nem<\/strong> <strong>felt\u00e9tlen\u00fcl sz\u00fcks\u00e9ges a p\u00e9nzmos\u00e1s \u00e9s terrorizmusfinansz\u00edroz\u00e1s megel\u0151z\u00e9s\u00e9hez<\/strong>, \u00e9s nem \u00e1ll ar\u00e1nyban az el\u00e9rni k\u00edv\u00e1nt c\u00e9llal, \u00edgy a Chart\u00e1ban r\u00f6gz\u00edtett fenti alapvet\u0151 jogok korl\u00e1toz\u00e1sa nem jogszer\u0171.<\/p><p>A p\u00e9nzmos\u00e1s elleni ir\u00e1nyelv \u00e1ltal bevezetett \u00faj rendszer ugyanis a mag\u00e1n\u00e9let tiszteletben tart\u00e1s\u00e1hoz \u00e9s a szem\u00e9lyes adatok v\u00e9delm\u00e9hez f\u0171z\u0151d\u0151 jogokba val\u00f3 l\u00e9nyegesen s\u00falyosabb beavatkoz\u00e1st jelent, mint a kor\u00e1bbi rendszer (amely, az illet\u00e9kes hat\u00f3s\u00e1gok \u00e9s bizonyos szervezetek hozz\u00e1f\u00e9r\u00e9se mellett lehet\u0151v\u00e9 tette b\u00e1rmely olyan szem\u00e9ly vagy szervezet hozz\u00e1f\u00e9r\u00e9s\u00e9t, aki vagy amely igazolni tudja jogos \u00e9rdek\u00e9t \u2013 <strong>a m\u00f3dos\u00edtott ir\u00e1nyelv m\u00e1r nem k\u00f6veteli meg a jogos \u00e9rdek igazol\u00e1s\u00e1t<\/strong>), an\u00e9lk\u00fcl, hogy ezt a s\u00falyos beavatkoz\u00e1st ellens\u00falyozhatn\u00e1k azok az el\u0151ny\u00f6k, amelyek az \u00faj rendszerb\u0151l k\u00f6vetkeznek (ti. a sz\u00e9lesebb k\u00f6r\u0171 transzparencia). Az a k\u00f6r\u00fclm\u00e9ny, hogy a hozz\u00e1f\u00e9r\u00e9shez f\u0171z\u0151d\u0151 jogos \u00e9rdekek k\u00f6r\u00e9nek meghat\u00e1roz\u00e1sa neh\u00e9zs\u00e9gekbe \u00fctk\u00f6zhet, nem indokolja, hogy az uni\u00f3s jogalkot\u00f3 a nyilv\u00e1noss\u00e1g sz\u00e1m\u00e1ra hozz\u00e1f\u00e9r\u00e9st biztos\u00edtson a k\u00e9rd\u00e9ses inform\u00e1ci\u00f3khoz.<\/p><p>A B\u00edr\u00f3s\u00e1g hozz\u00e1tette, hogy azok az opcion\u00e1lis ir\u00e1nyelvi rendelkez\u00e9sek, amelyek lehet\u0151v\u00e9 teszik a tag\u00e1llamok sz\u00e1m\u00e1ra, hogy a t\u00e9nyleges tulajdonosokra vonatkoz\u00f3 inform\u00e1ci\u00f3k megismerhet\u0151s\u00e9g\u00e9t online regisztr\u00e1ci\u00f3hoz k\u00f6ss\u00e9k, valamint amelyek \u2013 kiv\u00e9teles esetekben \u2013 elz\u00e1rhatj\u00e1k a nyilv\u00e1noss\u00e1got az eml\u00edtett inform\u00e1ci\u00f3khoz val\u00f3 hozz\u00e1f\u00e9r\u00e9st\u0151l, \u00f6nmagukban egyr\u00e9szt nem alkalmasak arra, hogy megfelel\u0151 egyens\u00falyt teremtsenek a k\u00f6z\u00e9rdek\u0171 c\u00e9l \u00e9s a mag\u00e1n\u00e9let tiszteletben tart\u00e1s\u00e1hoz \u00e9s a szem\u00e9lyes adatok v\u00e9delm\u00e9hez f\u0171z\u0151d\u0151 jogok \u00e9rv\u00e9nyes\u00fcl\u00e9se k\u00f6z\u00f6tt, m\u00e1sr\u00e9szt pedig nem biztos\u00edtanak megfelel\u0151 garanci\u00e1kat, amelyek lehet\u0151v\u00e9 teszik az \u00e9rintettek sz\u00e1m\u00e1ra a szem\u00e9lyes adataik hat\u00e9kony v\u00e9delm\u00e9t az esetleges vissza\u00e9l\u00e9sek vesz\u00e9lyeivel szemben.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-448a55c elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"448a55c\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-d52a2a7\" data-id=\"d52a2a7\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-bdf7930 elementor-widget elementor-widget-text-editor\" data-id=\"bdf7930\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Friss\u00edt\u00e9s (2022. december 6.)<\/strong>: A fenti \u00edr\u00e1s lez\u00e1r\u00e1s\u00e1t k\u00f6vet\u0151en a B\u00edr\u00f3s\u00e1g a LinkedIn profilj\u00e1n 2022. december 5-\u00e9n k\u00f6zz\u00e9tett egy <a href=\"https:\/\/eur05.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.linkedin.com%2Fposts%2Feuropean-court-of-justice_review-of-the-judgment-in-joined-cases-c-activity-7005505340528033792-1Pnt%3Futm_source%3Dshare%26utm_medium%3Dmember_desktop&amp;data=05%7C01%7CKrisztian.Sebok%40dlapiper.com%7C523caa2dcd1b4dc574f708dad76a4841%7Ce855e7acc54640d299f7a100522010f9%7C1%7C0%7C638059148721044262%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000%7C%7C%7C&amp;sdata=VaPcazfc81Kumu99VQUWRpD8YJcWEFHE9sYiYTOxIbM%3D&amp;reserved=0\">k\u00f6zlem\u00e9nyt<\/a> a fenti \u00edt\u00e9let \u00e9rtelmez\u00e9se k\u00f6r\u00e9ben, amellyel ki szerette volna igaz\u00edtani az \u00edt\u00e9let \u00e1ltal okozott ellentmond\u00e1sokat. A k\u00f6zlem\u00e9nyben a B\u00edr\u00f3s\u00e1g egy\u00e9rtelm\u0171s\u00edtette, hogy a d\u00f6nt\u00e9s\u00e9vel a p\u00e9nzmos\u00e1s elleni ir\u00e1nyelvet 2018-ban m\u00f3dos\u00edt\u00f3 ir\u00e1nyelv vonatkoz\u00f3 rendelkez\u00e9s\u00e9nek \u00e9rv\u00e9nytelens\u00e9g\u00e9t \u00e1llap\u00edtotta meg, r\u00f6gz\u00edtve, hogy ezzel az ir\u00e1nyelv r\u00e9gi, 2015-\u00f6s verzi\u00f3ja \u00e9rv\u00e9nyes \u00e9s alkalmazand\u00f3. K\u00f6vetkez\u00e9sk\u00e9pp, <strong>a t\u00e9nyleges tulajdonosi nyilv\u00e1ntart\u00e1sokhoz tov\u00e1bbra is hozz\u00e1f\u00e9rhet b\u00e1rki, amennyiben k\u00e9pes jogos \u00e9rdek\u00e9t bizony\u00edtani<\/strong>. A B\u00edr\u00f3s\u00e1g az \u00edt\u00e9let\u00e9ben maga is kiemel szem\u00e9lyeket, akik biztosan rendelkeznek jogos \u00e9rdekkel. A B\u00edr\u00f3s\u00e1g egyr\u00e9szt hangs\u00falyozza, hogy \u201emind a sajt\u00f3nak, mind a civil t\u00e1rsadalomhoz tartoz\u00f3, a p\u00e9nzmos\u00e1s \u00e9s a terrorizmusfinansz\u00edroz\u00e1s megel\u0151z\u00e9s\u00e9vel \u00e9s az azok elleni k\u00fczdelemmel kapcsolatban \u00e1ll\u00f3 szervezeteknek jogos \u00e9rdek\u00fck f\u0171z\u0151dik ahhoz, hogy hozz\u00e1f\u00e9rjenek a t\u00e9nyleges tulajdonosokra vonatkoz\u00f3 inform\u00e1ci\u00f3khoz\u201d. Az egyik t\u00e1rsas\u00e1g \u2013 amely tekintet\u00e9ben WM szerepelt t\u00e9nyleges tulajdonosk\u00e9nt a luxembourgi UBO nyilv\u00e1ntart\u00e1sban \u2013 k\u00e9relmezte, hogy t\u00e9nyleges tulajdonos\u00e1ra vonatkoz\u00f3 inform\u00e1ci\u00f3khoz val\u00f3 hozz\u00e1f\u00e9r\u00e9ssel kiz\u00e1r\u00f3lag bizonyos szervezetek (a nemzeti hat\u00f3s\u00e1gok, a hitel\u2011 \u00e9s p\u00e9nz\u00fcgyi int\u00e9zm\u00e9nyek, valamint a hivatalos szem\u00e9lyk\u00e9nt elj\u00e1r\u00f3 v\u00e9grehajt\u00f3k \u00e9s k\u00f6zjegyz\u0151k) rendelkezzenek, azzal az indokkal, hogy a lakoss\u00e1g ezen inform\u00e1ci\u00f3khoz val\u00f3 hozz\u00e1f\u00e9r\u00e9se \u0151t \u00e9s csal\u00e1dj\u00e1t jelent\u0151s m\u00e9rt\u00e9kben, val\u00f3san \u00e9s aktu\u00e1lisan ar\u00e1nytalan kock\u00e1zatnak \u00e9s csal\u00e1s, emberrabl\u00e1s, zsarol\u00e1s, k\u00e9nyszer\u00edt\u00e9s, zaklat\u00e1s, er\u0151szak vagy megf\u00e9leml\u00edt\u00e9s kock\u00e1zat\u00e1nak tenn\u00e9 ki. E k\u00e9relmet az LBR 2019. november 20\u2011i hat\u00e1rozat\u00e1val elutas\u00edtotta. E d\u00f6nt\u00e9ssel szemben \u00e9lt jogorvoslattal WM, arra hivatkozva, hogy \u00fcgyvezet\u0151k\u00e9nt \u00e9s t\u00e9nyleges tulajdonosk\u00e9nt gyakran olyan orsz\u00e1gokba kell utaznia, amelyek politikai rendszere instabil, \u00e9s amelyekben jelent\u0151s sz\u00e1mban k\u00f6vetnek el k\u00f6zt\u00f6rv\u00e9nyes b\u0171ncselekm\u00e9nyeket, aminek k\u00f6vetkezt\u00e9ben az emberrabl\u00e1s, beb\u00f6rt\u00f6nz\u00e9s, er\u0151szakos cselekm\u00e9nyek vagy ak\u00e1r hal\u00e1l jelent\u0151s vesz\u00e9lye fenyegeti.<\/p>\n<p><strong>[2]<\/strong> A Sovim SA \u00e9s az LBR (C\u2011601\/20. sz. \u00fcgy) k\u00f6z\u00f6tt annak t\u00e1rgy\u00e1ban folyamatban l\u00e9v\u0151 elj\u00e1r\u00e1sban terjesztett\u00e9k el\u0151, hogy az LBR nem akad\u00e1lyozta meg a lakoss\u00e1gnak a Sovim SA t\u00e9nyleges tulajdonos\u00e1ra vonatkoz\u00f3 inform\u00e1ci\u00f3khoz val\u00f3 hozz\u00e1f\u00e9r\u00e9s\u00e9t. A t\u00e1rsas\u00e1g \u00e9rvel\u00e9se szerint a t\u00e9nyleges tulajdonos szem\u00e9lyazonoss\u00e1g\u00e1hoz \u00e9s szem\u00e9lyes adataihoz val\u00f3 nyilv\u00e1nos hozz\u00e1f\u00e9r\u00e9s s\u00e9rti az Eur\u00f3pai Uni\u00f3 Alapjogi Chart\u00e1j\u00e1nak (a tov\u00e1bbiakban: Charta) 7. \u00e9s 8. cikk\u00e9ben biztos\u00edtott, a mag\u00e1n\u2011 \u00e9s a csal\u00e1di \u00e9let v\u00e9delm\u00e9hez val\u00f3 jogot, valamint a szem\u00e9lyes adatok v\u00e9delm\u00e9hez val\u00f3 jogot. E t\u00e1rsas\u00e1g v\u00e9lem\u00e9nye szerint ugyanis a m\u00f3dos\u00edtott 2015\/849 ir\u00e1nyelv c\u00e9lja a p\u00e9nzmos\u00e1s vagy a terrorizmusfinansz\u00edroz\u00e1s c\u00e9lj\u00e1ra haszn\u00e1lt t\u00e1rsas\u00e1gok t\u00e9nyleges tulajdonosainak azonos\u00edt\u00e1sa, valamint a kereskedelmi kapcsolatok biztons\u00e1g\u00e1nak \u00e9s a piacba vetett bizalomnak a biztos\u00edt\u00e1sa.
