Kiv\u00e9telnek sz\u00e1m\u00edtott a helyi, illetve ker\u00fcleti \u00f6nkorm\u00e1nyzatok \u00e1ltal \u2013 saj\u00e1t bel\u00e1t\u00e1suk szerint \u2013 telep\u00fcl\u00e9sk\u00e9pi rendeletben, telep\u00fcl\u00e9sk\u00e9pi bejelent\u00e9si elj\u00e1r\u00e1s lefolytat\u00e1s\u00e1hoz k\u00f6t\u00f6tt rendeltet\u00e9sv\u00e1ltoz\u00e1s, illetve az \u00fan. pl\u00e1zastop szab\u00e1lyoz\u00e1shoz kapcsol\u00f3d\u00f3an k\u00fcl\u00f6n korm\u00e1nyrendeletben r\u00e9szletesen szab\u00e1lyozott, 400 m<sup>2<\/sup>-n\u00e9l nagyobb brutt\u00f3 alapter\u00fclet\u0171 \u00e9p\u00edtm\u00e9nyek rendeltet\u00e9s\u00e9nek kereskedelmi rendeltet\u00e9sre t\u00f6rt\u00e9n\u0151 v\u00e1ltoztat\u00e1sa, \u00e1talak\u00edt\u00e1sa.<\/p><blockquote><p>A telep\u00fcl\u00e9sfejleszt\u00e9si koncepci\u00f3r\u00f3l, az integr\u00e1lt telep\u00fcl\u00e9sfejleszt\u00e9si strat\u00e9gi\u00e1r\u00f3l \u00e9s a telep\u00fcl\u00e9srendez\u00e9si eszk\u00f6z\u00f6kr\u0151l, valamint egyes telep\u00fcl\u00e9srendez\u00e9si saj\u00e1tos jogint\u00e9zm\u00e9nyekr\u0151l sz\u00f3l\u00f3 314\/2012. (XI. 8.) Korm. rendelet m\u00f3dos\u00edt\u00e1sa \u00e9rtelm\u00e9ben 2021. m\u00e1rcius\u00e1t\u00f3l a ter\u00fcletileg illet\u00e9kes polg\u00e1rmestern\u00e9l telep\u00fcl\u00e9sk\u00e9pi bejelent\u00e9si elj\u00e1r\u00e1st kell kezdem\u00e9nyezni az \u00e9p\u00edtm\u00e9nyek rendeltet\u00e9s\u00e9nek m\u00f3dos\u00edt\u00e1sa vagy rendeltet\u00e9si egys\u00e9ge sz\u00e1m\u00e1nak megv\u00e1ltoz\u00e1sa tekintet\u00e9ben.<\/p><\/blockquote><p>Az imm\u00e1ron (ism\u00e9telten) \u00e1ltal\u00e1nos jelleggel alkalmazand\u00f3 szab\u00e1lyok alapj\u00e1n az ingatlan tulajdonos\u00e1nak \u201ekv\u00e1zi\u201d enged\u00e9lyt kell k\u00e9rnie az illet\u00e9kes polg\u00e1rmestert\u0151l, amennyiben a kor\u00e1bbiakt\u00f3l elt\u00e9r\u0151 rendeltet\u00e9ssel k\u00edv\u00e1nja az ingatlan\u00e1t hasznos\u00edtani. Azt ugyanakkor \u00e9rdemes szem el\u0151tt tartani, hogy mindez azon esetekre vonatkozik, amikor a rendeltet\u00e9s m\u00f3dos\u00edt\u00e1sa nem j\u00e1r olyan \u00e9p\u00edt\u00e9si tev\u00e9kenys\u00e9ggel, amelyhez az \u00e9p\u00edt\u00e9s\u00fcgyi hat\u00f3s\u00e1g enged\u00e9ly\u00e9re lenne sz\u00fcks\u00e9g, mert ilyen esetekben a telep\u00fcl\u00e9sk\u00e9pi bejelent\u00e9si elj\u00e1r\u00e1s helyett \u00e9p\u00edt\u00e9s\u00fcgyi enged\u00e9lyez\u00e9si elj\u00e1r\u00e1s lefolytat\u00e1sa sz\u00fcks\u00e9ges.<\/p><p>A fenti jogszab\u00e1lym\u00f3dos\u00edt\u00e1sra tekintettel az \u00f6nkorm\u00e1nyzatoknak telep\u00fcl\u00e9sk\u00e9pi rendeleteikben, a telep\u00fcl\u00e9sk\u00e9pi bejelent\u00e9si elj\u00e1r\u00e1s szab\u00e1lyain bel\u00fcl kellett rendelkezni\u00fck a rendeltet\u00e9sm\u00f3dos\u00edt\u00e1s bejelent\u00e9s\u00e9nek szab\u00e1lyair\u00f3l, sz\u00fcks\u00e9g eset\u00e9n az addigi helyi szab\u00e1lyoz\u00e1s megfelel\u0151 kieg\u00e9sz\u00edt\u00e9s\u00e9vel.<\/p><p>A telep\u00fcl\u00e9sk\u00e9pi bejelent\u00e9si elj\u00e1r\u00e1s megind\u00edt\u00e1s\u00e1hoz az ingatlan tulajdonos\u00e1nak be kell ny\u00fajtania az adott ingatlan fekv\u00e9se szerinti telep\u00fcl\u00e9s (Budapesten az adott ker\u00fclet) polg\u00e1rmester\u00e9hez a helyi telep\u00fcl\u00e9sk\u00e9pi rendelet mell\u00e9klete szerint el\u0151k\u00e9sz\u00edtett k\u00e9relmet \u00e9s az ahhoz tartoz\u00f3 mell\u00e9kleteket. A k\u00e9relem k\u00f6telez\u0151 mell\u00e9klet\u00e9t k\u00e9pezi \u2013 egyebek mellett \u2013 a telep\u00fcl\u00e9sk\u00e9pi k\u00f6vetelm\u00e9nyeknek val\u00f3 megfelel\u00e9st igazol\u00f3 \u00e9p\u00edt\u00e9szeti-m\u0171szaki terv, valamint a telep\u00fcl\u00e9srendez\u00e9si eszk\u00f6z\u00f6kben szab\u00e1lyozott, a rendeltet\u00e9sekre vonatkoz\u00f3 k\u00f6vetelm\u00e9nyeknek val\u00f3 megfelel\u00e9st igazol\u00f3 dokument\u00e1ci\u00f3.<\/p><blockquote><p>A telep\u00fcl\u00e9sk\u00e9pi elj\u00e1r\u00e1sban jogszer\u0171 hallgat\u00e1snak van helye, ami azt jelenti, hogy amennyiben m\u00e1s enged\u00e9ly beszerz\u00e9se nem sz\u00fcks\u00e9ges, \u00e9s a bejelent\u00e9st k\u00f6vet\u0151 15 napon bel\u00fcl a polg\u00e1rmester nem hozza meg a d\u00f6nt\u00e9st, a rendeltet\u00e9sv\u00e1ltoz\u00e1s a polg\u00e1rmester d\u00f6nt\u00e9se n\u00e9lk\u00fcl megval\u00f3s\u00edthat\u00f3.<\/p><\/blockquote><p>Term\u00e9szetesen ez nem jelenti azt, hogy err\u0151l ne sz\u00fcletne \u00edr\u00e1sos dokumentum: a polg\u00e1rmester r\u00e1vezeti ezen szerzett jogot a telep\u00fcl\u00e9sk\u00e9pi bejelent\u00e9si elj\u00e1r\u00e1s lefolytat\u00e1s\u00e1ra ir\u00e1nyul\u00f3 k\u00e9relem tulajdonosn\u00e1l l\u00e9v\u0151 p\u00e9ld\u00e1ny\u00e1ra, vagy a polg\u00e1rmestern\u00e9l l\u00e9v\u0151 p\u00e9ld\u00e1nyr\u00f3l ad ki m\u00e1solatot a tulajdonos r\u00e9sz\u00e9re.<\/p><p>Amennyiben a polg\u00e1rmester a rendelkez\u00e9s\u00e9re \u00e1ll\u00f3 15 napos hat\u00e1rid\u0151n bel\u00fcl d\u00f6nt\u00e9st hoz, a d\u00f6nt\u00e9se h\u00e1romf\u00e9le lehet:<\/p><ol><li>Tudom\u00e1sul veszi a rendeltet\u00e9sv\u00e1ltoz\u00e1st (ehhez felt\u00e9telt is meghat\u00e1rozhat), ha a bejelent\u00e9s megfelel a jogszab\u00e1ly \u00e1ltal fel\u00e1ll\u00edtott tartalmi k\u00f6vetelm\u00e9nyeknek, \u00e9s a rendeltet\u00e9sv\u00e1ltoz\u00e1s \u00f6sszhangban \u00e1ll a helyi \u00e9p\u00edt\u00e9si szab\u00e1lyzattal.<\/li><li>Megtiltja a rendeltet\u00e9sv\u00e1ltoz\u00e1st, ha az nem felel meg a helyi \u00e9p\u00edt\u00e9si szab\u00e1lyzatban foglalt k\u00f6vetelm\u00e9nyeknek.<\/li><li>Megsz\u00fcnteti az elj\u00e1r\u00e1st, ha az el\u0151terjesztett k\u00e9relem nem felel meg a tartalmi k\u00f6vetelm\u00e9nyeknek.<\/li><\/ol><p>Megeml\u00edtend\u0151, hogy a polg\u00e1rmesterhez t\u00f6rt\u00e9n\u0151 bejelent\u00e9ssel \u00e9s \u2013 ide\u00e1lis esetben \u2013 a rendeltet\u00e9sv\u00e1ltoz\u00e1s tudom\u00e1sulv\u00e9tel\u00e9vel m\u00e9g nem \u00e9r v\u00e9get minden esetben a folyamat. A rendeltet\u00e9sv\u00e1ltoz\u00e1st sz\u00fcks\u00e9ges lehet \u00e1tvezettetni az ingatlan-nyilv\u00e1ntart\u00e1sban is, ehhez azonban nem elegend\u0151 a polg\u00e1rmester hat\u00e1rozata.<\/p><blockquote><p>A v\u00e1ltoz\u00e1s ingatlan-nyilv\u00e1ntart\u00e1si \u00e1tvezet\u00e9s\u00e9hez a rendeltet\u00e9sm\u00f3dos\u00edt\u00e1s megval\u00f3s\u00edt\u00e1s\u00e1t k\u00f6vet\u0151en a polg\u00e1rmester \u00e1ltal kiadott, a megval\u00f3s\u00edtott \u00faj rendeltet\u00e9st igazol\u00f3 hat\u00f3s\u00e1gi bizony\u00edtv\u00e1nya sz\u00fcks\u00e9ges, amelyet k\u00fcl\u00f6n kell megk\u00e9rni, \u00e9s amely az \u00e9p\u00edtm\u00e9ny, valamint az \u00e9p\u00edtm\u00e9nyen bel\u00fcli \u00f6n\u00e1ll\u00f3 rendeltet\u00e9si egys\u00e9g rendeltet\u00e9s\u00e9nek m\u00f3dos\u00edt\u00e1s\u00e1t \u00e9s \u00faj rendeltet\u00e9s\u00e9t, illetve \u2013 a rendeltet\u00e9si egys\u00e9gek sz\u00e1m\u00e1nak megv\u00e1ltoztat\u00e1sakor \u2013 az \u00e9p\u00edtm\u00e9ny rendeltet\u00e9si egys\u00e9gei sz\u00e1m\u00e1nak megv\u00e1ltoz\u00e1s\u00e1t \u00e9s az \u00faj rendeltet\u00e9ssz\u00e1m\u00e1t tartalmazza.<\/p><\/blockquote><p>Amennyiben a rendeltet\u00e9s megv\u00e1ltoztat\u00e1s\u00e1ra a telep\u00fcl\u00e9sk\u00e9pi bejelent\u00e9si elj\u00e1r\u00e1s lefolytat\u00e1sa n\u00e9lk\u00fcl ker\u00fclne sor, az a telep\u00fcl\u00e9sk\u00e9pi rendeletben foglalt telep\u00fcl\u00e9sk\u00e9pi k\u00f6vetelm\u00e9nyek megs\u00e9rt\u00e9s\u00e9t jelenti. Ilyen esetekben a polg\u00e1rmester el\u0151sz\u00f6r egy figyelmeztet\u0151 d\u00f6nt\u00e9sben, megfelel\u0151 hat\u00e1rid\u0151 t\u0171z\u00e9s\u00e9vel felh\u00edvja az ingatlan tulajdonos\u00e1t a jogszab\u00e1lys\u00e9rt\u00e9s megsz\u00fcntet\u00e9s\u00e9re, azaz a telep\u00fcl\u00e9sk\u00e9pi bejelent\u00e9si elj\u00e1r\u00e1s megind\u00edt\u00e1s\u00e1hoz sz\u00fcks\u00e9ges k\u00e9relem beny\u00fajt\u00e1s\u00e1ra. Amennyiben az ingatlan tulajdonosa a figyelmeztet\u0151 d\u00f6nt\u00e9snek a kit\u0171z\u00f6tt hat\u00e1rid\u0151n bel\u00fcl nem tesz eleget, akkor a polg\u00e1rmester k\u00f6telez\u00e9st bocs\u00e1t ki, \u00e9s telep\u00fcl\u00e9sk\u00e9p-v\u00e9delmi b\u00edrs\u00e1got szab ki. Ugyancsak a telep\u00fcl\u00e9sk\u00e9pi k\u00f6vetelm\u00e9nyek megs\u00e9rt\u00e9s\u00e9nek min\u0151s\u00fcl, ha az ingatlan tulajdonosa a polg\u00e1rmester tudom\u00e1sulv\u00e9telr\u0151l sz\u00f3l\u00f3 d\u00f6nt\u00e9s\u00e9t\u0151l elt\u00e9r\u0151en hajtja v\u00e9gre a rendeltet\u00e9s m\u00f3dos\u00edt\u00e1s\u00e1t, vagy ha a tilt\u00f3 d\u00f6nt\u00e9s ellen\u00e9re hajtja azt v\u00e9gre. Ebben a k\u00e9t esetben is a polg\u00e1rmester els\u0151k\u00e9nt a jogszab\u00e1lys\u00e9rt\u00e9s megsz\u00fcntet\u00e9s\u00e9re val\u00f3 felh\u00edv\u00e1st int\u00e9z az ingatlan tulajdonos\u00e1hoz, majd azt \u2013 az abban t\u0171z\u00f6tt hat\u00e1rid\u0151 eredm\u00e9nytelen letelt\u00e9t k\u00f6vet\u0151en \u2013 k\u00f6telez\u00e9s \u00e9s b\u00edrs\u00e1g k\u00f6vetheti. A telep\u00fcl\u00e9sk\u00e9p-v\u00e9delmi b\u00edrs\u00e1g legkisebb \u00f6sszege 100.000,- Ft, fels\u0151 hat\u00e1ra \u00f6nkorm\u00e1nyzatonk\u00e9nt v\u00e1ltozik (p\u00e9ld\u00e1ul egyes f\u0151v\u00e1rosi ker\u00fcletekben ez ak\u00e1r 1.000.000,- Ft is lehet).<\/p><p>A bemutatott jogszab\u00e1lym\u00f3dos\u00edt\u00e1s, \u00edgy a szigor\u00fabb\u00e1 tett elj\u00e1r\u00e1srend nyilv\u00e1nval\u00f3 c\u00e9lja egyfel\u0151l az ingatlan-nyilv\u00e1ntart\u00e1s adatainak naprak\u00e9szen tart\u00e1sa, m\u00e1sfel\u0151l a helyi \u00e9p\u00edt\u00e9si szab\u00e1lyzatban, illetve a helyi telep\u00fcl\u00e9sk\u00e9pi rendeletben foglaltak \u00e9rv\u00e9nyes\u00edt\u00e9s\u00e9nek el\u0151seg\u00edt\u00e9se.
