A m\u00f3dos\u00edt\u00e1s mintegy 86 \u00e1gazati t\u00f6rv\u00e9ny adatv\u00e9delmi rendelkez\u00e9seit m\u00f3dos\u00edtja a tavaly \u00e9letbe l\u00e9pett GDPR v\u00e9grehajt\u00e1s\u00e1hoz sz\u00fcks\u00e9ges jogrendszeri koherencia biztos\u00edt\u00e1sa \u00e9rdek\u00e9ben. Az \u00faj szab\u00e1lyok &#8211; n\u00e9h\u00e1ny kiv\u00e9tellel &#8211; a Magyar K\u00f6zl\u00f6nyben t\u00f6rt\u00e9n\u0151 kihirdet\u00e9st k\u00f6vet\u0151 15. napon l\u00e9pnek majd hat\u00e1lyba.<\/strong><br><\/p>\n<p>A m\u00f3dos\u00edt\u00e1s elfogad\u00e1s\u00e1val t\u00f6bbek k\u00f6z\u00f6tt t\u00f6rl\u00e9sre ker\u00fclnek a GDPR fogalom-meghat\u00e1roz\u00e1s\u00e1val azonos defin\u00edci\u00f3k, \u00e9rtelmez\u0151 rendelkez\u00e9sek, valamint a jogalapok k\u00fcl\u00f6n\u00f6s felt\u00e9telei, amennyiben ilyenek meg\u00e1llap\u00edt\u00e1s\u00e1ra nincs lehet\u0151s\u00e9g a GDPR alapj\u00e1n, tov\u00e1bb\u00e1 az Infotv-re vonatkoz\u00f3 utal\u00e1sok. Fontos szab\u00e1ly, hogy a deregul\u00e1ci\u00f3val a t\u00f6r\u00f6lt k\u00f6telezetts\u00e9g nem sz\u00fcks\u00e9gszer\u0171en sz\u0171nik meg, hanem sok esetben csup\u00e1n azt jelenti, hogy a k\u00f6telezetts\u00e9g a tov\u00e1bbiakban k\u00f6zvetlen\u00fcl a GDPR-b\u00f3l fakad.<\/p>\n<p>A m\u00f3dos\u00edt\u00e1s a munkaviszonyra vonatkoz\u00f3 szab\u00e1lyokat is \u00e9rinti, melyek k\u00f6z\u00fcl az al\u00e1bbiakban sz\u00e1mba vessz\u00fck a legfontosabbakat:<\/p>\n<p><strong>I. A munka t\u00f6rv\u00e9nyk\u00f6nyv\u00e9r\u0151l sz\u00f3l\u00f3 2012. \u00e9vi I. t\u00f6rv\u00e9ny (Mt.) m\u00f3dos\u00edt\u00e1sa:<\/strong><\/p>\n<p>A m\u00f3dos\u00edt\u00e1s folyt\u00e1n a munkav\u00e1llal\u00f3 szem\u00e9lyis\u00e9gi jogai korl\u00e1toz\u00e1s\u00e1nak felt\u00e9telei szigorodnak, mostant\u00f3l a korl\u00e1toz\u00e1sr\u00f3l el\u0151zetes \u00edr\u00e1sbeli t\u00e1j\u00e9koztat\u00e1st kell ny\u00fajtani, e t\u00e1j\u00e9koztat\u00e1snak pedig ki kell terjednie a korl\u00e1toz\u00e1s sz\u00fcks\u00e9gess\u00e9g\u00e9t \u00e9s ar\u00e1nyoss\u00e1g\u00e1t al\u00e1t\u00e1maszt\u00f3 k\u00f6r\u00fclm\u00e9nyekre is.<\/p>\n<p>Az Mt. \u00faj rendelkez\u00e9se egy\u00e9rtelm\u0171s\u00edti, hogy a munk\u00e1ltat\u00f3 a munkav\u00e1llal\u00f3t\u00f3l az Mt-b\u0151l sz\u00e1rmaz\u00f3 ig\u00e9ny \u00e9rv\u00e9nyes\u00edt\u00e9se szempontj\u00e1b\u00f3l l\u00e9nyeges nyilatkozat megt\u00e9tel\u00e9t vagy adat k\u00f6zl\u00e9s\u00e9t illet\u0151leg okirat bemutat\u00e1s\u00e1t is k\u00f6vetelheti, tov\u00e1bb\u00e1 feljogos\u00edtja a munk\u00e1ltat\u00f3t, az \u00fczemi tan\u00e1csot \u00e9s a szakszervezetet, hogy a munka\u00fcgyi kapcsolatokkal \u00f6sszef\u00fcgg\u00e9sben a jogok gyakorl\u00e1sa vagy k\u00f6teless\u00e9gek teljes\u00edt\u00e9se c\u00e9lj\u00e1b\u00f3l nyilatkozat megt\u00e9tel\u00e9t vagy adat k\u00f6zl\u00e9s\u00e9t illet\u0151leg okirat bemutat\u00e1s\u00e1t is k\u00f6vetelhesse. Ezen adatkezel\u00e9sekr\u0151l, valamint az alkalmazott alkalmass\u00e1gi vizsg\u00e1latokr\u00f3l a munk\u00e1ltat\u00f3 az \u00e9rintetteket, azaz a munkav\u00e1llal\u00f3kat \u00edr\u00e1sban k\u00f6teles t\u00e1j\u00e9koztatni.<\/p>\n<p>A m\u00f3dos\u00edt\u00e1s lehet\u0151v\u00e9 teszi a munk\u00e1ltat\u00f3 sz\u00e1m\u00e1ra a munkav\u00e1llal\u00f3 biometrikus adatainak kezel\u00e9s\u00e9t, m\u00e9gpedig abban az esetben, ha valamely dologhoz vagy adathoz, elz\u00e1rt ter\u00fclethez t\u00f6rt\u00e9n\u0151 jogosulatlan hozz\u00e1f\u00e9r\u00e9s megakad\u00e1lyoz\u00e1sa \u00e9rdek\u00e9ben sz\u00fcks\u00e9ges, \u00e9s a hozz\u00e1f\u00e9r\u00e9s a munkav\u00e1llal\u00f3 vagy m\u00e1sok \u00e9lete, testi \u00e9ps\u00e9ge vagy eg\u00e9szs\u00e9ge, vagy t\u00f6rv\u00e9nyben v\u00e9dett jelent\u0151s \u00e9rdek s\u00falyos vagy t\u00f6meges, visszaford\u00edthatatlan s\u00e9relm\u00e9nek a vesz\u00e9ly\u00e9vel j\u00e1rna. Jelent\u0151sen v\u00e9dett \u00e9rdek a m\u00f3dos\u00edt\u00e1s p\u00e9ld\u00e1l\u00f3z\u00f3 felsorol\u00e1sa szerint: a legal\u00e1bb &#8220;Bizalmas!&#8221; min\u0151s\u00edt\u00e9si szint\u0171 min\u0151s\u00edtett adatok v\u00e9delm\u00e9hez, a l\u0151fegyver, l\u0151szer, robban\u00f3anyag \u0151rz\u00e9s\u00e9hez, a m\u00e9rgez\u0151, vegyi vagy biol\u00f3giai, illet\u0151leg nukle\u00e1ris anyagok \u0151rz\u00e9s\u00e9hez, tov\u00e1bb\u00e1 az 50 milli\u00f3 Ft-ot meghalad\u00f3 \u00e9rt\u00e9k v\u00e9delm\u00e9hez f\u0171z\u0151d\u0151 \u00e9rdek.<\/p>\n<p>Az \u00faj szab\u00e1lyoz\u00e1s rendelkezik az erk\u00f6lcsi bizony\u00edtv\u00e1ny kezelhet\u0151s\u00e9g\u00e9r\u0151l is. A munkav\u00e1llal\u00f3 b\u0171n\u00fcgyi szem\u00e9lyes adata annak vizsg\u00e1lata c\u00e9lj\u00e1b\u00f3l kezelhet\u0151, hogy t\u00f6rv\u00e9ny vagy a munk\u00e1ltat\u00f3 a bet\u00f6lteni k\u00edv\u00e1nt vagy a bet\u00f6lt\u00f6tt munkak\u00f6rben nem korl\u00e1tozza vagy nem z\u00e1rja-e ki a foglalkoztat\u00e1st. A munk\u00e1ltat\u00f3 akkor hat\u00e1rozhat meg ilyen felt\u00e9telt, ha az \u00e9rintett szem\u00e9ly foglalkoztat\u00e1sa &#8211; t\u00f6bbek k\u00f6z\u00f6tt &#8211; a munk\u00e1ltat\u00f3 jelent\u0151s vagyoni \u00e9rdeke, t\u00f6rv\u00e9ny \u00e1ltal v\u00e9dett titok, vagy l\u0151fegyver, l\u0151szer, robban\u00f3anyag \u0151rz\u00e9s\u00e9hez, a m\u00e9rgez\u0151, vegyi vagy biol\u00f3giai, illet\u0151leg nukle\u00e1ris anyagok \u0151rz\u00e9s\u00e9hez f\u0171z\u0151d\u0151 \u00e9rdek s\u00e9relm\u00e9nek vesz\u00e9ly\u00e9vel j\u00e1rna. A munk\u00e1ltat\u00f3 az eml\u00edtett felt\u00e9teleket el\u0151zetesen \u00edr\u00e1sban k\u00f6teles meghat\u00e1rozni.<\/p>\n<p>A munk\u00e1ltat\u00f3 tov\u00e1bbra is jogosult a munkav\u00e1llal\u00f3t a munkaviszonnyal \u00f6sszef\u00fcgg\u0151 magatart\u00e1sa k\u00f6r\u00e9ben technikai eszk\u00f6zzel ellen\u0151rizni, err\u0151l el\u0151zetesen \u00edr\u00e1sban t\u00e1j\u00e9koztatni kell a munkav\u00e1llal\u00f3t. Alapesetben &#8211; amennyiben a felek m\u00e1sk\u00e9pp nem \u00e1llapodnak meg &#8211; a munkav\u00e1llal\u00f3 a r\u00e9sz\u00e9re biztos\u00edtott sz\u00e1m\u00edt\u00e1stechnikai eszk\u00f6zt kiz\u00e1r\u00f3lag a munkaviszony teljes\u00edt\u00e9se \u00e9rdek\u00e9ben haszn\u00e1lhatja. A munk\u00e1ltat\u00f3 az \u00e1tadott sz\u00e1m\u00edt\u00e1stechnikai eszk\u00f6z\u00f6n t\u00e1rolt, a munkaviszonnyal \u00f6sszef\u00fcgg\u0151 adatokba tekinthet be, azaz, egyez\u0151en az eddig kialakult gyakorlattal, az adatba az ellen\u0151rz\u00e9s sor\u00e1n addig tekinthet be, ameddig el nem tudja d\u00f6nteni, hogy az adat mag\u00e1nc\u00e9l\u00fa adat-e. Amennyiben mag\u00e1nc\u00e9l\u00fa az adat, azt tov\u00e1bb nem vizsg\u00e1lhatja, viszont a megfelel\u0151 munkajogi k\u00f6vetkezm\u00e9nyeket alkalmazhatja, ha a mag\u00e1nc\u00e9l\u00fa haszn\u00e1lat jogellenes volt.<\/p>\n<p><strong>II. A panaszokr\u00f3l \u00e9s a k\u00f6z\u00e9rdek\u0171 bejelent\u00e9sekr\u0151l sz\u00f3l\u00f3 2013. \u00e9vi CLXV. t\u00f6rv\u00e9ny (Pkbtv.) m\u00f3dos\u00edt\u00e1sa:<\/strong><\/p>\n<p>A m\u00f3dos\u00edt\u00e1ssal pontosodik a bejelent\u00e9sben \u00e9rintett szem\u00e9ly fogalma, ennek megfelel\u0151en bejelent\u00e9sben \u00e9rintett a bejelent\u0151, valamint az a szem\u00e9ly, akinek a magatart\u00e1sa vagy mulaszt\u00e1sa a bejelent\u00e9sre okot adott, vagy aki a bejelent\u00e9sben foglaltakr\u00f3l \u00e9rdemi inform\u00e1ci\u00f3val rendelkezhet.<\/p>\n<p>A m\u00f3dos\u00edt\u00e1s nem tartja fenn a k\u00fcl\u00f6nleges adatok kezel\u00e9s\u00e9re vonatkoz\u00f3 eddigi abszol\u00fat &#8211; \u00e9s a gyakorlatban megval\u00f3s\u00edthatatlan &#8211; tilalmat. Ezent\u00fal &#8211; garanci\u00e1k mellett &#8211; lehet\u0151v\u00e9 v\u00e1lik a k\u00fcl\u00f6nleges adatok \u00e9s a b\u0171n\u00fcgyi szem\u00e9lyes adatok kezel\u00e9se, ide\u00e9rtve ezen adatok bejelent\u0151v\u00e9delmi \u00fcgyv\u00e9d valamint a bejelent\u00e9s kivizsg\u00e1l\u00e1s\u00e1ban k\u00f6zrem\u0171k\u00f6d\u0151 szervezet r\u00e9sz\u00e9re t\u00f6rt\u00e9n\u0151 tov\u00e1bb\u00edt\u00e1s\u00e1t is.<\/p>\n<p>A m\u00f3dos\u00edt\u00e1s eredm\u00e9nyek\u00e9nt a bejelent\u0151 term\u00e9szetes szem\u00e9lynek a tov\u00e1bbiakban nem kell megadnia a bejelent\u00e9s megt\u00e9telekor a nev\u00e9t \u00e9s lakc\u00edm\u00e9t. Ezzel kapcsolatban a m\u00f3dos\u00edt\u00e1s indokl\u00e1sa jelzi, hogy a n\u00e9vtelen bejelent\u00e9seket a jogalkot\u00f3 nem t\u00e1mogatja, azonban az \u00e1ltal\u00e1nos adatv\u00e9delmi elvek &#8211; k\u00fcl\u00f6n\u00f6sen az anonimit\u00e1sra t\u00f6rekv\u00e9s &#8211; figyelembe v\u00e9tel\u00e9vel sz\u00fcks\u00e9gtelennek tartja az anonim rendszerek m\u0171k\u00f6dtet\u00e9s\u00e9nek akad\u00e1lyoz\u00e1s\u00e1t.<\/p>\n<p>A bejelent\u0151v\u00e9delmi rendszerek vonatkoz\u00e1s\u00e1ban m\u00f3dosul tov\u00e1bb\u00e1 a szem\u00e9lyes adatok k\u00fclf\u00f6ldre t\u00f6rt\u00e9n\u0151 tov\u00e1bb\u00edt\u00e1s\u00e1nak szab\u00e1lyai, miszerint m\u00e1s \u00e1llamba vagy nemzetk\u00f6zi szervezet r\u00e9sz\u00e9re t\u00f6rt\u00e9n\u0151 tov\u00e1bb\u00edt\u00e1sra kiz\u00e1r\u00f3lag a tov\u00e1bb\u00edt\u00e1s c\u00edmzettje \u00e1ltal tett, a bejelent\u00e9sre vonatkoz\u00f3, a Pkbtv-ben foglalt szab\u00e1lyok betart\u00e1s\u00e1ra ir\u00e1nyul\u00f3 jogi k\u00f6telezetts\u00e9gv\u00e1llal\u00e1s eset\u00e9n ker\u00fclhet sor.<\/p>\n<p><strong>III. A szem\u00e9ly- \u00e9s vagyonv\u00e9delmi, valamint a mag\u00e1nnyomoz\u00f3i tev\u00e9kenys\u00e9g szab\u00e1lyair\u00f3l sz\u00f3l\u00f3 2005. \u00e9vi CXXXIII. t\u00f6rv\u00e9ny (Szvmtv.) m\u00f3dos\u00edt\u00e1sa:<\/strong><\/p>\n<p>A legfontosabb v\u00e1ltoz\u00e1sok az adatkezel\u00e9sek jogalapj\u00e1t \u00e9s a meg\u0151rz\u00e9si id\u0151ket \u00e9rintik. Az eddigi speci\u00e1lis szab\u00e1lyok (pl. a szem\u00e9lyes adatok megsemmis\u00edt\u00e9se 6 h\u00f3nap ut\u00e1n, vagy elektronikus megfigyel\u0151rendszerek eset\u00e9n a 3 munkanapos, 30 napos illet\u0151leg 60 napos \u0151rz\u00e9si id\u0151k, elektronikus bel\u00e9ptet\u0151 rendszerek est\u00e9n az azonnali, 24 \u00f3r\u00e1s illet\u0151leg 6 h\u00f3napos t\u00f6rl\u00e9si id\u0151k) t\u00f6rl\u00e9sre ker\u00fclnek. Ez azonban nem jelenti azt, hogy ezent\u00fal korl\u00e1tlan ideig lehet ezen adatokat kezelni, hanem a GDPR \u00e1ltal\u00e1nos rendelkez\u00e9sei alapj\u00e1n kell az adatmeg\u0151rz\u00e9si hat\u00e1rid\u0151ket meg\u00e1llap\u00edtani.<\/p>\n<p>A m\u00f3dos\u00edt\u00e1s egy\u00e9b rendelkez\u00e9sei: A vagyon\u0151r a tov\u00e1bbiakban kiz\u00e1r\u00f3lag mag\u00e1nter\u00fcleten alkalmazhat elektronikus megfigyel\u0151rendszert. T\u00f6rl\u00e9sre ker\u00fclnek a mag\u00e1nter\u00fclet k\u00f6z\u00f6ns\u00e9g sz\u00e1m\u00e1ra nyilv\u00e1nos r\u00e9sz\u00e9re, valamint a r\u00e1utal\u00f3 magatart\u00e1ssal t\u00f6rt\u00e9n\u0151 hozz\u00e1j\u00e1rul\u00e1s szab\u00e1lyaira vonatkoz\u00f3 k\u00fcl\u00f6n rendelkez\u00e9sek.
