A rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si elj\u00e1r\u00e1s a gyakorlatban azzal j\u00e1r, hogy a 400 m\u00b2-n\u00e9l nagyobb brutt\u00f3 alapter\u00fclet\u0171 \u00e9p\u00edtm\u00e9nyek tulajdonosai az \u00faj rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si enged\u00e9ly beszerz\u00e9se n\u00e9lk\u00fcl m\u00e1r nem tudj\u00e1k az \u00e9p\u00edtm\u00e9nyek kereskedelemi rendeltet\u00e9s\u0171 ter\u00fclet\u00e9t n\u00f6velni \u00fagy, hogy nem \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles munk\u00e1latokkal a m\u00e1r megl\u00e9v\u0151, nem kereskedelmi rendeltet\u00e9s\u0171 \u00e9p\u00edtm\u00e9nyeket (pl. irod\u00e1kat, t\u00e1rol\u00f3kat) \u00e1talak\u00edtj\u00e1k.<\/p>\n<p><strong>Jogszab\u00e1lyi h\u00e1tt\u00e9r:<\/strong><\/p>\n<p>A kereskedelemi \u00e9p\u00edtm\u00e9nyek \u00e9p\u00edt\u00e9s\u00e9vel, \u00e1talak\u00edt\u00e1s\u00e1val, b\u0151v\u00edt\u00e9s\u00e9vel \u00e9s rendeltet\u00e9sm\u00f3dos\u00edt\u00e1s\u00e1val kapcsolatos, a k\u00f6ztudatban <strong>&#8220;pl\u00e1zastop t\u00f6rv\u00e9ny&#8221;<\/strong> n\u00e9ven meghonosodott szab\u00e1lyoz\u00e1st t\u00f6bb jogszab\u00e1ly tartalmazza:<\/p>\n<p style=\"padding-left: 30px\">a) az \u00e9p\u00edtett k\u00f6rnyezet alak\u00edt\u00e1s\u00e1r\u00f3l \u00e9s v\u00e9delm\u00e9r\u0151l sz\u00f3l\u00f3 1997. \u00e9vi LXXVIII. t\u00f6rv\u00e9ny (a tov\u00e1bbiakban: <strong>&#8220;\u00c9ptv.&#8221;<\/strong>) IV\/A fejezete, amelyet 2018 augusztus\u00e1ban eg\u00e9sz\u00edtettek ki;<\/p>\n<p style=\"padding-left: 30px\">b) a rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si elj\u00e1r\u00e1s sor\u00e1n alkalmazand\u00f3 r\u00e9szletes szab\u00e1lyokr\u00f3l sz\u00f3l\u00f3 143\/2018. (VIII. 13.) Korm. rendelet (a tov\u00e1bbiakban: <strong>&#8220;Korm\u00e1nyrendelet&#8221;<\/strong>), amely 2018 augusztus\u00e1ban l\u00e9pett hat\u00e1lyba;<\/p>\n<p style=\"padding-left: 30px\">c) a 400 m2-n\u00e9l nagyobb brutt\u00f3 alapter\u00fclet\u0171 kereskedelmi \u00e9p\u00edtm\u00e9nyekre vonatkoz\u00f3 el\u0151zetes szakhat\u00f3s\u00e1gi \u00e1ll\u00e1sfoglal\u00e1s kiad\u00e1sa ir\u00e1nti k\u00e9relem tartalmi k\u00f6vetelm\u00e9nyeinek, az elj\u00e1r\u00e1sban k\u00f6zrem\u0171k\u00f6d\u0151 Bizotts\u00e1g m\u0171k\u00f6d\u00e9s\u00e9nek egyes szab\u00e1lyair\u00f3l sz\u00f3l\u00f3 5\/2015. (I.29.) Korm. rendelet.<\/p>\n<p>Az augusztusi m\u00f3dos\u00edt\u00e1sok hat\u00e1lyba l\u00e9p\u00e9se el\u0151tt csak a 400 m\u00b2-n\u00e9l nagyobb brutt\u00f3 alapter\u00fclet\u0171 kereskedelmi \u00e9p\u00edtm\u00e9nyek \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles elj\u00e1r\u00e1saiban kellett alkalmazni a speci\u00e1lis szab\u00e1lyokat, azonban a m\u00f3dos\u00edt\u00e1sok k\u00f6vetkezt\u00e9ben m\u00e1r a nem \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles \u00e1talak\u00edt\u00e1si munk\u00e1latokn\u00e1l \u00e9s \u00e9p\u00edtm\u00e9nyek rendeltet\u00e9s\u00e9nek m\u00f3dos\u00edt\u00e1s\u00e1n\u00e1l is szigor\u00fa elj\u00e1r\u00e1si rend alkalmazand\u00f3.<\/p>\n<p>A k\u00f6vetkez\u0151ekben k\u00fcl\u00f6n-k\u00fcl\u00f6n bemutatjuk az \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles \u00e9s a nem \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles elj\u00e1r\u00e1sokat az \u00e9rintett, 400 m\u00b2-n\u00e9l nagyobb brutt\u00f3 alapter\u00fclet\u0171 \u00e9p\u00edtm\u00e9nyek vonatkoz\u00e1s\u00e1ban.<\/p>\n<p><strong>\u00c9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles elj\u00e1r\u00e1sok:<\/strong><\/p>\n<p>Az \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles elj\u00e1r\u00e1sokra az \u00c9ptv. IV\/A fejezet\u00e9nek 57\/B. \u00a7- 57\/E. \u00a7-sai az ir\u00e1nyad\u00f3ak.<\/p>\n<p>A &#8220;hagyom\u00e1nyos&#8221; \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles elj\u00e1r\u00e1sokn\u00e1l szigor\u00fabb szab\u00e1lyok a 400 m\u00b2-n\u00e9l nagyobb brutt\u00f3 alapter\u00fclet\u0171 kereskedelmi \u00e9p\u00edtm\u00e9nyek \u00e9p\u00edt\u00e9s\u00e9nek, \u00e1talak\u00edt\u00e1s\u00e1nak, valamint a 400 m\u00b2-t meghalad\u00f3 brutt\u00f3 alapter\u00fcletre val\u00f3 b\u0151v\u00edt\u00e9s\u00e9nek \u00e9p\u00edt\u00e9s\u00fcgyi hat\u00f3s\u00e1gi enged\u00e9lyez\u00e9si elj\u00e1r\u00e1s\u00e1ban alkalmazand\u00f3ak.<\/p>\n<p>Kereskedelmi \u00e9p\u00edtm\u00e9nyk\u00e9nt az \u00c9ptv. 57\/B. \u00a7-sa az \u00fczleteket \u00e9s a bev\u00e1s\u00e1rl\u00f3k\u00f6zpontokat jel\u00f6li meg, azonban ezek pontos defin\u00edci\u00f3ja kapcs\u00e1n a kereskedelemr\u0151l sz\u00f3l\u00f3 2005. \u00e9vi CLXIV. t\u00f6rv\u00e9nyre utal.<\/p>\n<p>A kereskedelmi t\u00f6rv\u00e9ny alapj\u00e1n az \u00fczlet <em>&#8220;kereskedelmi tev\u00e9kenys\u00e9g folytat\u00e1sa c\u00e9lj\u00e1b\u00f3l l\u00e9tes\u00edtett vagy haszn\u00e1lt \u00e9p\u00fclet, illetve \u00f6n\u00e1ll\u00f3 rendeltet\u00e9si egys\u00e9get k\u00e9pez\u0151 \u00e9p\u00fcletr\u00e9sz, helyis\u00e9g, ide\u00e9rtve az els\u0151dlegesen rakt\u00e1roz\u00e1s, t\u00e1rol\u00e1s c\u00e9lj\u00e1t szolg\u00e1l\u00f3 olyan \u00e9p\u00fcletet vagy \u00e9p\u00fcletr\u00e9szt is, amelyben kereskedelmi tev\u00e9kenys\u00e9get folytatnak.&#8221;<\/em> A bev\u00e1s\u00e1rl\u00f3k\u00f6zpont pedig olyan <em>&#8220;komplex kialak\u00edt\u00e1s\u00fa, vegyes rendeltet\u00e9s\u0171 \u00e9p\u00fclet, amelyben \u00e1lland\u00f3 jelleggel t\u00f6bb keresked\u0151 folytat t\u00falnyom\u00f3r\u00e9szt \u00fczletekben k\u00fcl\u00f6nb\u00f6z\u0151 t\u00edpus\u00fa kereskedelmi tev\u00e9kenys\u00e9get, \u00e9s ahol emellett jellemz\u0151en a szabadid\u0151 elt\u00f6lt\u00e9s\u00e9vel \u00f6sszef\u00fcgg\u0151 szolg\u00e1ltat\u00e1si tev\u00e9kenys\u00e9get is folytatnak.&#8221;<\/em><\/p>\n<p>A k\u00e9relmez\u0151 <em>(azon szem\u00e9ly, aki az \u00e9p\u00edt\u00e9si enged\u00e9ly ir\u00e1nti k\u00e9relmet beny\u00fajtja az \u00e9p\u00edt\u00e9s\u00fcgyi hat\u00f3s\u00e1ghoz)<\/em> az \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles \u00e9p\u00edt\u00e9si, \u00e1talak\u00edt\u00e1si \u00e9s b\u0151v\u00edt\u00e9si munk\u00e1latok megkezd\u00e9se el\u0151tt az \u00e9p\u00edt\u00e9s\u00fcgyi hat\u00f3s\u00e1gt\u00f3l k\u00f6teles enged\u00e9lyt k\u00e9rni. Az \u00e9p\u00edt\u00e9s\u00fcgyi hat\u00f3s\u00e1g \u00fcgyint\u00e9z\u00e9si hat\u00e1rideje 75 nap a k\u00e9relem beny\u00fajt\u00e1s\u00e1nak napj\u00e1t\u00f3l sz\u00e1m\u00edtva. Az \u00e9p\u00edt\u00e9s\u00fcgyi hat\u00f3s\u00e1g a hat\u00f3s\u00e1gi enged\u00e9lyez\u00e9si elj\u00e1r\u00e1s\u00e1ban az orsz\u00e1gos illet\u00e9kess\u00e9ggel elj\u00e1r\u00f3 Hajd\u00fa-Bihar Megyei Korm\u00e1nyhivatal (a tov\u00e1bbiakban: <strong>&#8220;Korm\u00e1nyhivatal&#8221;<\/strong>) szakhat\u00f3s\u00e1gi \u00e1ll\u00e1sfoglal\u00e1s\u00e1t k\u00f6teles beszerezni. A Korm\u00e1nyhivatal \u00fcgyint\u00e9z\u00e9si hat\u00e1rideje 60 nap, ami az \u00e9p\u00edt\u00e9s\u00fcgyi hat\u00f3s\u00e1g 75 napos \u00fcgyint\u00e9z\u00e9si hat\u00e1ridej\u00e9be belesz\u00e1m\u00edt. A Korm\u00e1nyhivatal elj\u00e1r\u00e1sa sor\u00e1n egyeztet az \u00e9p\u00edt\u00e9s\u00fcgyi szab\u00e1lyoz\u00e1s\u00e9rt \u00e9s \u00e9p\u00edt\u00e9shat\u00f3s\u00e1gi \u00fcgyek\u00e9rt felel\u0151s miniszter, a kereskedelem\u00e9rt, a telep\u00fcl\u00e9sfejleszt\u00e9s\u00e9rt \u00e9s telep\u00fcl\u00e9srendez\u00e9s\u00e9rt, a k\u00f6rnyezetv\u00e9delem\u00e9rt, valamint a k\u00f6zleked\u00e9s\u00e9rt felel\u0151s miniszterek k\u00e9pvisel\u0151inek r\u00e9szv\u00e9tel\u00e9vel m\u0171k\u00f6d\u0151 bizotts\u00e1ggal, amelynek v\u00e9lem\u00e9nye a Korm\u00e1nyhivatalra nem k\u00f6telez\u0151 \u00e9rv\u00e9ny\u0171, a Korm\u00e1nyhivatal azonban a bizotts\u00e1g v\u00e9lem\u00e9ny\u00e9nek beszerz\u00e9se n\u00e9lk\u00fcl nem d\u00f6nthet.<\/p>\n<p>A Korm\u00e1nyhivatal a szakhat\u00f3s\u00e1gi hozz\u00e1j\u00e1rul\u00e1s megad\u00e1sa sor\u00e1n azt vizsg\u00e1lja, hogy a kereskedelmi \u00e9p\u00edtm\u00e9nnyel kapcsolatos \u00e9p\u00edt\u00e9si, \u00e1talak\u00edt\u00e1si \u00e9s b\u0151v\u00edt\u00e9si munk\u00e1latok a telep\u00fcl\u00e9sre \u00e9s vonz\u00e1sk\u00f6rzet\u00e9re nem okoznak-e olyan h\u00e1tr\u00e1nyos k\u00f6vetkezm\u00e9nyeket, amelyek ar\u00e1nytalanul meghaladj\u00e1k az \u00e9p\u00edt\u00e9si, \u00e1talak\u00edt\u00e1si \u00e9s b\u0151v\u00edt\u00e9si munk\u00e1latokt\u00f3l v\u00e1rhat\u00f3 el\u0151ny\u00f6ket.<\/p>\n<p>A k\u00e9relmez\u0151 k\u00e9rheti a Korm\u00e1nyhivatalt\u00f3l el\u0151zetes szakhat\u00f3s\u00e1gi hozz\u00e1j\u00e1rul\u00e1s megad\u00e1s\u00e1t is. Ilyen esetben a k\u00e9relmez\u0151 a szakhat\u00f3s\u00e1gi hozz\u00e1j\u00e1rul\u00e1s megad\u00e1sa \u00e9rdek\u00e9ben k\u00f6zvetlen\u00fcl ny\u00fajtja be a k\u00e9relm\u00e9t a Korm\u00e1nyhivatalhoz, m\u00e9g miel\u0151tt \u00e9p\u00edt\u00e9si enged\u00e9ly ir\u00e1nti k\u00e9relmet ny\u00fajtana be az \u00e9p\u00edt\u00e9s\u00fcgyi hat\u00f3s\u00e1ghoz. Ennek el\u0151nye az, hogy ebben az esetben az \u00e9p\u00edt\u00e9s\u00fcgyi hat\u00f3s\u00e1ghoz a k\u00e9relmez\u0151 a m\u00e1r beszerezett szakhat\u00f3s\u00e1gi hozz\u00e1j\u00e1rul\u00e1ssal egy\u00fctt tudja beny\u00fajtani az \u00e9p\u00edt\u00e9si enged\u00e9ly ir\u00e1nti k\u00e9relm\u00e9t. A megadott szakhat\u00f3s\u00e1gi hozz\u00e1j\u00e1rul\u00e1st a k\u00e9relmez\u0151 a k\u00e9zbes\u00edt\u00e9st\u0151l sz\u00e1m\u00edtott egy \u00e9ven bel\u00fcl haszn\u00e1lhatja fel az \u00e9p\u00edt\u00e9si enged\u00e9lyez\u00e9si elj\u00e1r\u00e1sban.<\/p>\n<p><strong>Nem \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles elj\u00e1r\u00e1sok:<\/strong><\/p>\n<p>A 400 m\u00b2-n\u00e9l nagyobb brutt\u00f3 alapter\u00fclet\u0171 \u00e9p\u00edtm\u00e9nyek vonatkoz\u00e1s\u00e1ban a nem \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles, de a &#8220;pl\u00e1zastop t\u00f6rv\u00e9ny&#8221; hat\u00e1lya al\u00e1 tartoz\u00f3 elj\u00e1r\u00e1sok szab\u00e1lyait az \u00c9ptv. 57\/F. \u00a7-a (<em>az 57\/F. \u00a7-sal 2018 augusztus\u00e1ban ker\u00fclt kieg\u00e9sz\u00edt\u00e9sre az \u00c9ptv.)<\/em> \u00e9s a Korm\u00e1nyrendelet tartalmazza. Ezen nem \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles elj\u00e1r\u00e1sokat az \u00c9ptv. \u00e9s a Korm\u00e1nyrendelet \u00f6sszefoglal\u00f3 n\u00e9ven rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si elj\u00e1r\u00e1soknak nevezi.<\/p>\n<p>A Korm\u00e1nyrendelet 1. \u00a7-a hat\u00e1rozza meg pontosan, hogy mely \u00e9p\u00edtm\u00e9nyekkel kapcsolatos, milyen tev\u00e9kenys\u00e9gek tartoznak a rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si elj\u00e1r\u00e1sok k\u00f6r\u00e9be:<\/p>\n<p style=\"padding-left: 30px\">a) a 400 m\u00b2 vagy azt meghalad\u00f3 brutt\u00f3 alapter\u00fclet\u0171 \u00e9p\u00edtm\u00e9nyek rendeltet\u00e9s\u00e9nek kereskedelmi rendeltet\u00e9sre v\u00e1ltoztat\u00e1sa;<\/p>\n<p style=\"padding-left: 30px\">b) kereskedelmi \u00e9p\u00edtm\u00e9ny olyan \u00e1talak\u00edt\u00e1sa ir\u00e1nti elj\u00e1r\u00e1s, amely \u00e9p\u00edt\u00e9si enged\u00e9lyhez nem k\u00f6t\u00f6tt, \u00e9s amelynek sor\u00e1n a kereskedelmi tev\u00e9kenys\u00e9ggel \u00e9rintett \u00e9p\u00edtm\u00e9ny brutt\u00f3 alapter\u00fclete meghaladja majd a 400 m\u00b2-t;<\/p>\n<p style=\"padding-left: 30px\">c) a 400 m\u00b2 brutt\u00f3 alapter\u00fcletet meghalad\u00f3 kereskedelmi \u00e9p\u00edtm\u00e9ny nem \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles \u00e1talak\u00edt\u00e1sa.<\/p>\n<p>A fenti a) ponttal bevezetett szigor\u00edt\u00e1s k\u00f6vetkezt\u00e9ben m\u00e1r nincs arra lehet\u0151s\u00e9g, hogy a 400 m\u00b2 vagy azt meghalad\u00f3 brutt\u00f3 alapter\u00fclet\u0171 \u00e9p\u00edtm\u00e9nyekben a Korm\u00e1nyhivatal hat\u00f3s\u00e1gi \u00e1ll\u00e1sfoglal\u00e1s\u00e1t kiker\u00fclve \u00fagy alak\u00edtsanak ki \u00fczleteket, hogy a m\u00e1r megl\u00e9v\u0151 \u00e9p\u00edtm\u00e9ny rendeltet\u00e9s\u00e9t megv\u00e1ltoztatj\u00e1k kereskedelmi rendeltet\u00e9sre. Ebb\u0151l k\u00f6vetkez\u0151en teh\u00e1t, amennyiben p\u00e9ld\u00e1ul egy ingatlan tulajdonosa irodahelyis\u00e9ge(ke)t k\u00edv\u00e1n \u00e1talak\u00edtani \u00e9s \u00fczletk\u00e9nt haszn\u00e1lni, k\u00f6teles a rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si elj\u00e1r\u00e1st elind\u00edtani, felt\u00e9ve, hogy az \u00e9rintett \u00e9p\u00edtm\u00e9ny brutt\u00f3 alapter\u00fclete legal\u00e1bb 400 m\u00b2.<\/p>\n<p>A fenti b) pont \u00e9rtelm\u00e9ben a rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si elj\u00e1r\u00e1s hat\u00e1lya al\u00e1 esnek azon b\u0151v\u00edt\u00e9sek is, amelyek sor\u00e1n az egy\u00e9bk\u00e9nt 400 m\u00b2-n\u00e9l kisebb, nem kereskedelmi rendeltet\u00e9s\u0171 helyis\u00e9gek (pl. iroda, t\u00e1rol\u00f3 helyis\u00e9g) \u00e1talak\u00edt\u00e1s\u00e1val olyan kereskedelmi \u00e9p\u00edtm\u00e9nyt b\u0151v\u00edtenek, amelynek brutt\u00f3 alapter\u00fclete a b\u0151v\u00edt\u00e9ssel meghaladja majd a 400 m\u00b2-t.<\/p>\n<p>A fenti c) pont alapj\u00e1n a rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si elj\u00e1r\u00e1s hat\u00e1lya al\u00e1 ker\u00fcltek a 400 m\u00b2 brutt\u00f3 alapter\u00fcletet meghalad\u00f3 kereskedelmi \u00e9p\u00edtm\u00e9nyekkel kapcsolatos, \u00e9p\u00edt\u00e9si enged\u00e9lyhez nem k\u00f6t\u00f6tt \u00e1talak\u00edt\u00e1sok is.<\/p>\n<p>Az \u00e1talak\u00edt\u00e1s vonatkoz\u00e1s\u00e1ban a gyakorlat az orsz\u00e1gos telep\u00fcl\u00e9srendez\u00e9si \u00e9s \u00e9p\u00edt\u00e9si k\u00f6vetelm\u00e9nyekr\u0151l sz\u00f3l\u00f3 253\/1997. (XII. 20.) Korm. rendelet (&#8220;OT\u00c9K&#8221;) fogalom meghat\u00e1roz\u00e1s\u00e1t haszn\u00e1lja, amelynek alapj\u00e1n az \u00e1talak\u00edt\u00e1s a <em>&#8220;megl\u00e9v\u0151 \u00e9p\u00edtm\u00e9ny, \u00e9p\u00edtm\u00e9nyr\u00e9sz, \u00f6n\u00e1ll\u00f3 rendeltet\u00e9si egys\u00e9g, helyis\u00e9g alaprajzi elrendez\u00e9s\u00e9nek vagy k\u00fcls\u0151 megjelen\u00e9s\u00e9nek, megv\u00e1ltoztat\u00e1sa \u00e9rdek\u00e9ben v\u00e9gzett, az \u00e9p\u00edtm\u00e9ny bels\u0151 t\u00e9rfogat\u00e1t nem n\u00f6vel\u0151 \u00e9p\u00edt\u00e9si tev\u00e9kenys\u00e9g.&#8221;<\/em><\/p>\n<p>\u00d6sszefoglalva teh\u00e1t, minden olyan kisebb \u00e1talak\u00edt\u00e1si munk\u00e1lat a fenti c) pontban utalt k\u00f6rbe esik, amely a helyis\u00e9g alaprajzi elrendez\u00e9s\u00e9t megv\u00e1ltoztatja, azonban nem \u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles. A rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si elj\u00e1r\u00e1s szab\u00e1lyait kell alkalmazni p\u00e9ld\u00e1ul azokban az esetekben, amikor egy bels\u0151 v\u00e1laszfalat lebontanak, \u00e1thelyeznek vagy pr\u00f3baf\u00fclk\u00e9k elhelyez\u00e9s\u00e9t megv\u00e1ltoztatj\u00e1k.<\/p>\n<p>A rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si enged\u00e9ly ir\u00e1nti k\u00e9relmet az \u00e9p\u00edtm\u00e9ny fekv\u00e9se szerinti j\u00e1r\u00e1s sz\u00e9khely\u00e9n m\u0171k\u00f6d\u0151 telep\u00fcl\u00e9si \u00f6nkorm\u00e1nyzat jegyz\u0151j\u00e9hez, a f\u0151v\u00e1rosi ker\u00fcletben a f\u0151v\u00e1rosi ker\u00fcleti \u00f6nkorm\u00e1nyzat jegyz\u0151j\u00e9hez, a F\u0151v\u00e1rosi \u00d6nkorm\u00e1nyzat \u00e1ltal k\u00f6zvetlen\u00fcl igazgatott ter\u00fclet tekintet\u00e9ben a f\u0151v\u00e1rosi f\u0151jegyz\u0151h\u00f6z (egy\u00fcttesen a tov\u00e1bbiakban: <strong>&#8220;rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si hat\u00f3s\u00e1g&#8221;<\/strong>) kell beny\u00fajtani. A k\u00e9relemhez a 5\/2015. (I. 29.) Korm. rendelet 1. \u00e9s 2. sz\u00e1m\u00fa mell\u00e9klet\u00e9ben felsorolt dokumentumokat kell csatolni <em>(azon dokumentumokat, amelyeket az el\u0151zetes szakhat\u00f3s\u00e1gi hozz\u00e1j\u00e1rul\u00e1s ir\u00e1nti k\u00e9relemhez is csatolni kell).<\/em><\/p>\n<p>A rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si hat\u00f3s\u00e1g az enged\u00e9ly megad\u00e1sa el\u0151tt, az elj\u00e1r\u00e1s megindul\u00e1s\u00e1t sz\u00e1m\u00edtott 5 napon bel\u00fcl, megkeresi a Korm\u00e1nyhivatalt szakhat\u00f3s\u00e1gi \u00e1ll\u00e1sfoglal\u00e1s kiad\u00e1sa c\u00e9lj\u00e1b\u00f3l. A Korm\u00e1nyhivatal az \u00e1ll\u00e1sfoglal\u00e1s kiad\u00e1s el\u0151tt egyeztet a fentebb eml\u00edtett miniszteri k\u00e9pvisel\u0151kb\u0151l \u00e1ll\u00f3 bizotts\u00e1ggal. A rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si hat\u00f3s\u00e1g \u00fcgyint\u00e9z\u00e9si hat\u00e1rideje 75 nap a k\u00e9relem beny\u00fajt\u00e1s\u00e1nak napj\u00e1t\u00f3l sz\u00e1m\u00edtva, amelybe a Korm\u00e1nyhivatal legfeljebb 60 napos \u00fcgyint\u00e9z\u00e9si hat\u00e1rideje belesz\u00e1m\u00edt.<\/p>\n<p>A rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si elj\u00e1r\u00e1s abban teh\u00e1t megegyezik az \u00e9p\u00edt\u00e9si enged\u00e9lyez\u00e9si elj\u00e1r\u00e1ssal, hogy a k\u00e9relmez\u0151 az els\u0151fok\u00fa hat\u00f3s\u00e1ghoz <em>(\u00e9p\u00edt\u00e9si enged\u00e9lyk\u00f6teles elj\u00e1r\u00e1sban az els\u0151fok\u00fa \u00e9p\u00edt\u00e9s\u00fcgyi hat\u00f3s\u00e1ghoz, jelen eseten pedig az els\u0151fok\u00fa rendeltet\u00e9sm\u00f3dos\u00edt\u00e1si hat\u00f3s\u00e1ghoz)<\/em> ny\u00fajtja be a k\u00e9relm\u00e9t, amely a Korm\u00e1nyhivatalt\u00f3l beszerzi a szakhat\u00f3s\u00e1gi \u00e1ll\u00e1sfoglal\u00e1st.
