OLG Nuremberg: Release obligation for junior ranking mortgages

The Higher Regional Court (Oberlandesgericht, “OLG”) of Nuremberg confirmed that an insolvency administrator may demand the holder of a junior ranking compulsory enforcement mortgage (Zwangssicherungshypothek) to release its mortgage without compensation if the prior ranking encumbrances are so high, that the mortgage appears obviously economically worthless.
